     Extends immunity from liability to nonprofit associations engaged in organizing, teaching, refereeing, or coaching sports activity under State law requiring protective eyewear for children who participate in certain sports.

An Act concerning immunity for certain nonprofit sports associations and amending P.L.2005, c.306.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 3 of P.L.2005, c.306 (C.5:18-3) is amended to read as follows:

     3.    No school, community [or], government agency, or nonprofit association or member of such an association engaged in organizing, teaching, refereeing or coaching a sports activity described in section 1 of this act shall be liable in a civil action for failure to administer or enforce the provisions of this act.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     In January of 2006, the Legislature approved P.L.2005, c.306 (C.5:18-1 et seq.) to mandate that a child who wears corrective eyeglasses while participating in certain sports sponsored by a school, community, or government agency is required to wear protective eyewear that meets the frame standards of the American Society for Testing and Materials (ASTM) F803 and the lens standards of the American National Standards Institute (ANSI) Z87.1.  The law includes a provision which grants immunity from liability to a school, community, or government agency engaged in organizing, teaching, refereeing, or coaching a sports activity for failure to administer or enforce the provisions of the law.

     This bill extends that immunity to a nonprofit association or member of such an association that is similarly engaged in organizing, teaching, refereeing, or coaching a sports activity, such as the New Jersey State Interscholastic Athletic Association and the New Jersey High School Tennis Officials Association among others.
