An Act concerning child study team members and amending P.L.1982, c.162.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.1982, c.162 (C.18A:46-5.1) is amended to read as follows:

     1.    Each board of education and State operated program shall separately or jointly with one or more boards of education or State agencies provide for basic child study team services.  The basic child study team shall consist of a school psychologist, a learning disability teacher consultant and a school social worker, and for the purposes of evaluation and classification shall include pertinent information from certified school personnel making the referral.  This information shall be considered in the evaluation and classification process as defined in N.J.A.C. [6:28-1.1 et seq] 6A:14-1.1 et seq

     The referring certified school personnel and the school principal, or his designee, may attend the classification conference as defined in N.J.A.C. [6:28-1.1 et seq.] 6A:14-1.1 et seq. and participate in the classification decision.

     The basic child study team shall be comprised of employees of a board of education or persons who are employed by an agency or clinic approved by the Department of Education to provide special education services to school districts.  A member of a basic child study team shall hold the appropriate certificate issued by the State Board of Examiners.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that a basic child study team may be comprised of employees of a school district or persons who are employed by an agency or clinic approved by the Department of Education to provide special education services to school districts.  Under the bill, a member of a basic child study team must hold the appropriate certificate issued by the State Board of Examiners.

     Currently, State Board of Education regulation N.J.A.C.6A:14-3.1(b) requires child study team members to be employees of a district board of education.
