AMENDED ANALYSIS
This bill expands the definition of provider under the therapeutic cannabis program to include a provider licensed to prescribe medication and who is primarily responsible for the patient's care related to his or her qualifying medical condition. The bill also requires, for issuance of a registry identification card to a minor, certification from 2 providers, one of whom shall provide pediatric care.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Four
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Use of Cannabis for Therapeutic Purposes; Definition of Provider. Amend RSA 126-X:1, VII(a)(3) and (4) to read as follows:
(3) A physician or advanced practice registered nurse licensed to prescribe drugs to humans under the relevant state licensing laws in Maine, Massachusetts, or Vermont and who possesses an active registration from the United States Drug Enforcement Administration to prescribe controlled substances and who is primarily responsible for the patient's care related to his or her qualifying medical condition; [or]
(4) A physician assistant licensed pursuant to RSA 328-D and who possesses an active registration from the United States Drug Enforcement Administration to prescribe controlled substances, with the express consent of the supervising physician[.]; or
(5) Any other New Hampshire provider who is licensed to prescribe drugs to humans and who possesses an active registration from the United States Drug Enforcement Administration to prescribe controlled substances and who is primarily responsible for the patient's care related to his or her qualifying medical condition.
2 Registry Identification Cards; Qualifications for Minors. Amend RSA 126-X:4, V(a) to read as follows:
(a) A custodial parent or legal guardian responsible for health care decisions for the qualifying patient submits a written certification from 2 providers, one of whom shall be a [pediatrician] pediatric care provider.
3 Effective Date. This act shall take effect 60 days after its passage.
