STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to lucky 7 licenses.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Bingo and Lucky 7; Financial Reports and Inspection Required.  Amend RSA 287-E:9, IV to read as follows:

IV. All charitable organizations licensed under this chapter shall maintain a separate checking account for the deposit and disbursement of all income relating to bingo and lucky 7, except cash prizes awarded at the games. All expenses shall be paid by check, or electronic funds transfers. All prizes [of $500 or more shall be paid by check] shall be paid in compliance with Internal Revenue Service W-2G requirements and all such required documentation shall be available for inspection by the commission. There shall be no commingling of bingo and lucky 7 funds with other funds of the charitable organization. The organization shall retain all [cancelled checks] canceled checks or required documentation for the payment of expenses and prizes for at least 2 years. The organization may cash checks which it issues.

2  Lucky 7 Licenses.  Amend RSA 287-E:20, I to read as follows:

I. The license shall specify where the tickets may be offered for sale, provided that the license shall not authorize a charitable organization to sell lucky 7 tickets except at a place where a bingo game has been authorized, at a facility licensed under RSA 287-D, or in a town or city which has authorized the sale of lucky 7 tickets under RSA 287-E:27.

3  Sale of Lucky 7 Tickets.  Amend RSA 287-E:21, III-a to read as follows:

III-a. Lucky 7 tickets may be sold by dispenser devices approved by the commission and located at the regular meeting place of, or at a facility owned, leased, or utilized by, the licensee for its activities, including facilities licensed under RSA 287-D, provided that such device dispenses a paper or cardboard ticket and specifications for such dispenser device are contained in the rules of the commission.  Any permitted lucky 7 device shall not be in the nature of a slot machine and the outcome of any wager involving a permitted lucky 7 device shall be determined by the cardboard or paper ticket, or the video monitor when so equipped. Devices capable of displaying the outcome on a video monitor shall provide the player with the option of printing a paper ticket. No charitable organization shall be licensed to sell lucky 7 tickets for more than 10 days per month when selling tickets at a facility licensed under RSA 287-D.  Lucky 7 tickets sold at said facilities may be sold during all hours for which the facility is licensed to operate.

4  Bingo and Lucky 7; Financial Reports and Inspections.  Amend RSA 287-E:24, IV to read as follows:

IV.  All expenses shall be paid by check or electronic funds transfers, [and] all cash prizes [of $500 or more shall be paid by check,] shall be paid in compliance with Internal Revenue Service W-2G requirements, and all such required documentation shall be available for inspection by the commission [and]. The charitable organization shall retain [cancelled checks] canceled checks or required documentation or bank produced facsimiles of [cancelled] canceled checks for the payment of expenses and checks or bank produced facsimiles of checks and receipts for the payment of prizes for a period of 2 years.

5  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill permits games of chance facilities to offer Lucky 7 tickets without also conducting bingo.  The Lottery Commission assumes this would not materially increase the number of locations offering Lucky 7 tickets, however, it would likely reduce the number of games of chance facilities that offer bingo games as many of these games are presently offered only for the purpose of permitting Lucky 7 sales. Permitting Lucky 7 sales at games of chance facilities without the requirement to host a bingo event is likely to have a small but undeterminable negative impact on bingo revenues as it is anticipated some games of chance facilities will discontinue their bingo games. These games, however, tended to be very small and therefore likely would not have a material impact to state revenue (Lottery revenue is credited to the lottery fund, with net revenues after expenditures being credited to the state education trust fund). The Commission states inspection and audit of these facilities will not be substantially impacted by this change as the monitoring of the extended hours can be accomplished by flexing the time of the existing inspection and audit staff as necessary, therefore, does not expect that this bill would have an impact on state expenditures.
