STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT requiring the Medicaid managed care program to cover telemedicine services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Medicaid Managed Care Program; Definition Added. Amend RSA 126-A:5, XIX(c) by inserting after subparagraph (4) the following new subparagraph:

(5) “Telemedicine” means the use of audio, video, or other electronic media for the purpose of diagnosis, consultation, or treatment, but does not include the use of audio-only telephone or facsimile.

2 New Subparagraph; Medicaid Managed Care Program; Telemedicine. Amend RSA 126-A:5, XIX by inserting after subparagraph (d) the following new subparagraph:

(e) Coverage under this paragraph shall include the use of telemedicine for covered services provided within the scope of practice of a physician or other health care provider as a method of delivery of medical care by which an individual shall receive medical services from a health care provider without in-person contact with the provider. Nothing in this subparagraph shall be construed to prohibit a managed care vendor from providing coverage for only those services that are medically necessary and subject to all other the terms and conditions of the coverage. 3 Effective Date. This act shall take effect 60 days after its passage.
