STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT relative to forfeiture fees regarding dog licenses.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Dog License; Late Payment of Fees. Amend RSA 466:13 to read as follows:
466:13 Forfeiture. Whoever is the owner or keeper of a dog and who fails to license or renew the dog license pursuant to RSA 466:1 shall forfeit $25 to the town or city clerk of the municipality in which the dog is kept. If the forfeiture is not made to the town or city clerk within [15] 45 calendar days of the notice of forfeiture, the case may be disposed of in a district court as a violation with a fine not to exceed $50, notwithstanding the provisions of RSA 651:2, IV. A forfeiture shall not relieve the owner or keeper of the requirement of proper licensing of the dog as required by RSA 466:1. This section shall also apply to cats, if the municipality licenses cats. Any forfeitures collected under this section may be retained by the city or town for the administration and enforcement of this chapter.
2 Effective Date. This act shall take effect January 1, 2019.

METHODOLOGY:
This bill would amend RSA 466:13 concerning the payment of a $25 forfeiture fee to the town or city clerk for failure to license or renew the license of a dog. Failure to pay the $25 fee can result in a violation level offense in the district division of the circuit court. This bill would increase the time allowed to pay the fee and avoid the violation offense from 15 calendar days to 45 calendar days.
The Judicial Branch assumes by allowing an additional month for payment of the forfeiture fee, the bill could result in fewer violation level offenses in the district division. The Branch has no information on which to estimate how many fewer violation level offenses may result from the bill, but does have information on the average cost of processing such cases in the trial court. The average violation level offense in the district division of the circuit court is estimated to be $49 in FY 2019 and FY 2020. These numbers do not consider the cost of any appeals that may be taken following trial. It should be noted that average case cost estimates for FY 2019 and FY 2020 are based on data that is more than ten years old and does not reflect changes to the courts over that same period of time or the impact these changes may have on processing the various case types.
The New Hampshire Municipal Association states it is unlikely that there would be a fiscal impact on local expenditures.
The New Hampshire Association of Counties states there is no fiscal impact on the counties based on the language of this bill.
