STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT relative to employee compensation at certain hospitals.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Compensation of Employees at Non-Profit Facilities.  Amend RSA 151 by inserting after section 12-b the following new section:

151:12-c  Compensation of Employees at Non-Profit Facilities; Penalty.

I.  In this section:

(a)  "Compensation" means salary, bonus payments whether based on performance or otherwise, deferred compensation, incentive payments, severance payments, loans to be repaid on terms, including interest, less than market rate, value of facility-provided vehicle, housing or other prerequisites not available to all employees, stock or stock options, and any dividends or other incidents of the ownership of such facility.

(b)  "Minimum facility compensation" means the value of the annual compensation received by the lowest-paid full-time employee.

II.  If an employee of a non-profit general acute care hospital, non-profit acute psychiatric hospital, non-profit acute specialty hospital, or any other non-profit acute care facility required to be licensed under this chapter which accepts funds from the state of New Hampshire receives annual compensation greater than 100 times the minimum facility compensation, such facility shall be subject to a civil penalty equal to the amount by which the employee's annual compensation exceeds 100 times the value of the minimum facility compensation.  

2  Effective Date.  This act shall take effect January 1, 2017.
