STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT relative to railroad motorcars.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraphs; Off Highway Recreational Vehicles; Definitions. Amend RSA 215-A:1 by inserting after paragraph XXII the following new paragraphs:

XXIII. “Antique railroad motorcar” means any railroad motorcar 25 or more years old.

XXIV. “Railroad motorcar,” also known as section car, track car, and putt putt, means any vehicle propelled by mechanical power with flanged wheels that is designed and specifically manufactured for use on standard railroad tracks.

2 New Paragraph; Off Highway Recreational Vehicles; Registration; Railroad Motorcar. Amend RSA 215-A:21 by inserting after paragraph IV-d the following new paragraph:

IV-e. Antique railroad motorcars may be registered by a one-time purchase of a permanent plate to be affixed permanently to the antique railroad motorcar vehicle. This registration shall be available at the fish and game headquarters only.

3 Off Highway Recreational Vehicles; Registration Fees; Antique Railroad Motorcars. Amend the introductory paragraph of RSA 215-A:23, II-b to read as follows:

II-b. Resident antique trail bike and antique railroad motorcar permanent registration-- $46.50 for each registration upon presentation of a valid New Hampshire driver’s license issued to a person 18 years of age or older. From each fee collected pursuant to this paragraph:

4 New Paragraph; OHRV Operation and License; Railroad Motorcars. Amend RSA 215-A:29 by inserting after paragraph XIX the following new paragraph:

XX. No person shall operate a railroad motorcar on railroad tracks for recreational purposes that has not been approved by the bureau of trails.

5 Off Highway Vehicles; Evaluation Process. Amend the introductory paragraph of RSA 215-A:43, IV to read as follows:

IV. Except as provided in paragraph IV-a, no person shall operate an OHRV wider than 50 inches or over 1,000 pounds on any state-owned trails, except that no person shall operate an OHRV wider than 62 inches or over 1,700 pounds on:

IV-a. No person shall operate a railroad motorcar wider than 65 inches and 1,500 pounds.

7 Effective Date. This act shall take effect 60 days after its passage.
