AN ACT repealing certain task forces, study committees, and study commissions , repealing the John G. Winant memorial commission and making the maintenance of the memorial a duty of the joint legislative historical committee, and establishing a committee to study the appeals process administered by the environmental councils established under RSA 21-O.

I.  Repeals the requirement that house and senate committee services staff jointly prepare an annual index of all commissions.

 

II.  Repeals task forces, study committees, and study commissions.

 

III.  Establishes a committee to study the department of environmental services appeals process.

 

IV.  Repeals the John G. Winant memorial commission and makes the maintenance of the memorial a duty of the joint legislative historical committee.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT repealing certain task forces, study committees, and study commissions , repealing the John G. Winant memorial commission and making the maintenance of the memorial a duty of the joint legislative historical committee, and establishing a committee to study the appeals process administered by the environmental councils established under RSA 21-O.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Air Pollution Advisory Committee; Cross Reference Removed.  Amend the introductory paragraph of RSA 125-O:21, VI to read as follows:

VI. The department of environmental services and the department of energy shall report on an annual basis to [the air pollution advisory committee under RSA 125-J:11,] the chair of the house science, technology, and energy committee, and the chair of the senate energy and natural resources committee on the status of the implementation of RGGI in New Hampshire, with emphasis on the prices and availability of RGGI allowances to affected CO2 sources, consumer protection mechanisms, and the trends in electric rates for New Hampshire businesses and ratepayers. The report shall include, but not be limited to:

II. In addition to the provisions of paragraph I, the commissioner, after consultation with the commissioner of health and human services, shall limit to the greatest extent practicable, with the approval of the governor and council, the concentration of MTBE allowed in any gasoline sold in all or part of the state after first holding a public hearing on the issue and [certifying to the air pollution advisory committee established in RSA 125-J:11] determining that gasolines which meet such limit are:

3  Department of Environmental Services; Appeals Process Study Committee Established.

I.  There is hereby established a committee to study the appeals process administered by the environmental councils established under RSA 21-O.

II.  The members of the committee shall be as follows:

(a)  Two members of the house of representatives, appointed by the speaker of the house of representatives; and

(b)  One member of the senate, appointed by the president of the senate.

III.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

IV.  The duties of the committee shall be as follows:

(a)  Study the appeals process of the environmental councils established in RSA 21-O with a focus on expediting appeals resolutions;

(b)  Improve the cost effectiveness of the appeals process; and

(c)  Consult with the chairmen of the 4 environmental councils to accomplish these goals.

V.  The members of the committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named house member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Two members of the committee shall constitute a quorum.

VI.  The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2024.

4  New Paragraph; Joint Legislative Historical Committee; Responsibilities.  Amend RSA 17-I:2 by inserting after paragraph IX the following new paragraph:

X.  Overseeing the maintenance of the John G. Winant memorial.

5  Repeal.  The following are repealed:

I.  2001, 271:1, relative to the task force to conduct an ongoing study of the feasibility of re-establishing the Lawrence, Massachusetts to Manchester, New Hampshire rail service line and the Concord to Lebanon northern passenger rail service line.

II.  RSA 125-J:11, relative to the air pollution advisory committee.

III. RSA 4:9-l and 4:9-m, relative to the John G. Winant memorial commission.

IV.  RSA 14:49, II(e), relative to the annual index of commissions, is repealed.

V.  RSA 404-J:1, relative to the commission on the status of health coverage markets for individuals and small employers.

6  Effective Date.  This act shall take effect upon its passage.
