A BILL TO BE ENTITLED
AN ACT TO make it a class 1 misdemeanor to trespass on school grounds.
The General Assembly of North Carolina enacts:
SECTION 1. Article 22 of Chapter 14 of the General Statutes is amended by adding a new section to read:
"§ 14‑132.3. Trespass on school grounds.
(a) For purposes of this section, the term "school premises" includes any school building and any educational property as defined by G.S. 14‑269.2 that is within 500 feet of a school building.
(b) During the period of one hour prior to the start of school and one hour after the conclusion of a school session, it is unlawful for any person to enter the premises of a public or private elementary, middle, or secondary school unless the person meets one of the following qualifications:
(1) Is an enrolled student in, a parent or guardian of an enrolled student in, or an employee of the school or school district.
(2) Has permission or an invitation from a school official to be on the school premises.
(3) Is attending a school event, class, or meeting to which the person, the public, or a student's family is invited.
(4) Has reported the person's presence on the school premises in the manner required for visitors to school.
(c) A violation of this section is a Class 1 misdemeanor."
SECTION 2. This act becomes effective December 1, 2013, and applies to offenses committed on or after that date.
