A BILL TO BE ENTITLED

AN ACT to give the governor limited flexibility to remove gubernatorial appointees to boards and commissions during their terms of office.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 128‑7 reads as rewritten:

"§ 128‑7.  Officer Service at the pleasure of Governor; Officer to hold until successor qualified.

(a)        The Governor may remove without cause during a calendar year not more than one‑fourth of the members of a board or commission who are serving a fixed term of office. This subsection does not apply to board or commission members not appointed by the Governor.

(b)        All Except if removed from office, all officers shall continue in their respective offices until their successors are elected or appointed, and duly qualified."

SECTION 2.  G.S. 143B‑13 is amended by adding a new subsection to read:

"(d1)    As provided by G.S. 128‑7(a) the Governor may remove without cause during a calendar year not more than one‑fourth of the members of a board or commission who are serving a fixed term of office. This subsection does not apply to board or commission members not appointed by the Governor."

SECTION 3.  This act is effective when it becomes law.
