A BILL TO BE ENTITLED

AN ACT TO require the department of public instruction to use a specified amount of child nutrition program funds as required state matching funds for meals under the national school lunch program, as recommended by the legislative task force on childhood obesity.

The General Assembly of North Carolina enacts:

SECTION 1.  Of the funds appropriated to the Department of Public Instruction for the Child Nutrition Program for the 2010‑2011 fiscal year, the sum of five million two hundred thousand dollars ($5,200,000) shall be used as State matching funds necessary to draw down federal funds for school meals under the United States Department of Agriculture National School Lunch Program.  These funds shall be used only for food and food preparation costs in the Child Nutrition Program.

SECTION 2.  This act becomes effective July 1, 2010.
