A BILL TO BE ENTITLED
AN ACT allowing persons practicing as certified professional midwives in this state to continue to provide midwifery services without being subject to criminal penalty.
The General Assembly of North Carolina enacts:
SECTION 1. Chapter 90 of the General Statutes is amended by adding a new Article to read:
"Article 10B.
"Practice of Midwifery by Certified Professional Midwives.
"§ 90‑178.10. Practice of midwifery by certified professional midwife.
Notwithstanding any other provision of law to the contrary, any person who holds a current ministerial or tocological certification from an organization accredited by the Institute for Credentialing Excellence (ICE) may provide services as described in 42 U.S.C. § 1396r‑6(b)(4)(E)(ii)(l)."
SECTION 2. This act is effective when it becomes law.
