AN ACT MAKING AN ADDITIONAL APPROPRIATION OF CAPITAL EXPENSE FUNDS, AND SPECIAL FUNDS TO DEFRAY THE EXPENSES OF THE OFFICE OF THE ATTORNEY GENERAL FOR FISCAL YEARS 2023 AND 2024; THE STATE VETERANS AFFAIRS BOARD FOR FISCAL YEARS 2023 AND 2024; THE DEPARTMENT OF PUBLIC SAFETY FOR FISCAL YEAR 2023; THE DEPARTMENT OF EDUCATION FOR FISCAL YEAR 2023; THE DEPARTMENT OF FINANCE AND ADMINISTRATION FOR FISCAL YEARS 2023 AND 2024; THE DEPARTMENT OF WILDLIFE FISHERIES AND PARKS FOR FISCAL YEAR 2023; THE STATE VETERANS HOME PURCHASE BOARD FOR FISCAL YEAR 2023; THE BOARD OF ANIMAL HEALTH FOR FISCAL YEAR 2023; THE ADMINISTRATIVE OFFICE OF COURTS FOR FISCAL YEAR 2023; EAST CENTRAL COMMUNITY COLLEGE FOR FISCAL YEAR 2023; HINDS COMMUNITY COLLEGE FOR FISCAL YEAR 2023; MISSISSIPPI BOARD OF REGISTERED PROFESSIONAL GEOLOGISTS FOR FISCAL YEAR 2023; MISSISSIPPI DEPARTMENT OF INFORMATION TECHNOLOGY SERVICES FOR FISCAL YEARS 2023 AND 2024.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of paying for certain outside legal assistance, expert witness fees, court fees, judgments and settlement agreements incurred by the Office of the Attorney General for the period beginning July 1, 2022, and ending June 30, 2023............................... $ 604,310.00.

     Of the funds appropriated in this section, the following amounts are provided:

          (a)  Curtis Flowers v. State of Mississippi, Circuit Court of Montgomery County, Mississippi,

Cause No. 1:20-cv-00150............................ $  50,000.00.

(b)  Harvill Payne Richardson v. State of Mississippi, Circuit Court of Harrison County, Mississippi, Second Judicial District, Cause No. A2402-2020-87.................................. $  50,000.00.

          (c)  Eddie Lee Howard v. State of Mississippi, Circuit Court of Lowndes County, Mississippi,

Cause No. 2021-0026-CV1C........................... $  50,000.00.

          (d)  Carl Lee Jordan v. State of Mississippi, Cause No. A2401-2020-160; Circuit Court of Harrison County,

Mississippi....................................... $  50,000.00.

          (e)  Delaughter v. Woodall, et al,

1:14-cv-00018-RHWR................................. $ 404,310.00.

SECTION 2.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of paying for certain outside legal assistance, expert witness fees, court fees, judgments and settlement agreements incurred by the Office of the Attorney General for the period beginning upon passage of this act and ending June 30, 2024.................. $ 985,000.00.

     Of the funds appropriated in this section, the following amounts are provided:

(a)  United States v. State of Mississippi, 3:16-cv-622-CWR-FKB (S.D. Miss)....................................... $ 100,000.00.

(b)  IRS v. State Agencies............... $ 235,000.00.

          (c)  White., et al v. State Board of Election

Commissioners...................................... $ 300,000.00.

(d)  United States Department of Justice CRIPA Investigation of MDOC.............................................. $ 350,000.00.

SECTION 3.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the State Veterans Affairs Board for the period beginning July 1, 2022, and ending June 30, 2023.............. $ 416,869.00.

     This additional appropriation is for the purpose of defraying expenses related to an ACA penalty.

SECTION 4.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money in the State Treasury and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the State Veterans Affairs Board for the period beginning upon passage of this act and

ending June 30, 2024............................. $ 1,266,025.00.

     This additional appropriation is for the purpose of capital repairs at the State Veterans' Homes.

SECTION 5.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Department of Public Safety for the period beginning July 1, 2022, and ending June 30, 2023................ $   932,902.00.

     This additional appropriation is for the purpose of defraying expenses related to an ACA penalty.

SECTION 6.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the General Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Department of Education for the period beginning July 1, 2022, and ending June 30, 2023............................ $ 20,000,000.00.

     This additional appropriation is for the purpose of defraying the expenses of the Mississippi Adequate Education Program.

     SECTION 7.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money in the State Treasury, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Department of Education for the period beginning July 1, 2022, and

ending June 30, 2023............................ $ 20,000,000.00.

     This additional appropriation is for the purpose of defraying the expenses of the Educational Facilities Revolving Loan Fund Program.

     SECTION 8.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Coronavirus State Fiscal Recovery Fund, and allocated in a manner as determined by the Treasurer's Office to defray the expenses of the Department of Finance and Administration for the period beginning upon passage of this act, and

ending June 30, 2024 ........................... $  6,000,000.00.

     This additional appropriation is for the purpose of defraying eligible administration and reporting expenses related to the Coronavirus State Fiscal Recovery Funds incurred on or after March 3, 2021, through the final expenditure date as determined by the U.S. Treasury.

     SECTION 9.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital City Water/Sewer Projects Fund, and allocated in a manner as determined by the Treasurer's Office to defray the expenses of the Department of Finance and Administration for the period beginning upon passage of this act, and

ending June 30, 2024............................ $ 30,000,000.00.

     This additional appropriation is for the purpose of providing funds to assist the City of Jackson, Mississippi, in paying costs associated with construction, reconstruction, repairs, upgrades and improvements to the City of Jackson's water and sewer systems and related facilities as authorized in Section 29-5-251, Mississippi Code 1972.

SECTION 10.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Department of Wildlife, Fisheries, and Parks for the period beginning July 1, 2022, and ending June 30, 2023 $  1,376,228.00.

     This additional appropriation is for the purpose of defraying expenses related to an ACA penalty.

     SECTION 11.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money in the State Treasury, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Veterans' Home Purchase Board for the period beginning July 1, 2022, and

ending June 30, 2023............................ $ 25,000,000.00.

     This additional appropriation is for the purpose of defraying expenses related to providing new home loans to veterans.

SECTION 12.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Board of Animal Health for the period beginning July 1, 2022, and ending June 30, 2023................... $   220,783.00.

     This additional appropriation is for the purpose of defraying operational expenses.

SECTION 13.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the General Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Administrative Office of Courts at the Mississippi State Supreme Court for the period beginning July 1, 2022, and

ending June 30, 2023............................. $   625,000.00.

     This additional appropriation is for the purpose of defraying expenses related to the Youth Court Support Program to assist counties in maintaining and operating Youth Courts.

     SECTION 14.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of East Central Community College for the period beginning July 1, 2022, and

ending June 30, 2023.............................. $  101,182.00.

     This additional appropriation is for the purpose of defraying the expenses of career and technical education teachers.

     SECTION 15.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of Hinds Community College for the period beginning July 1, 2022, and

ending June 30, 2023.............................. $  169,572.00.

     This additional appropriation is for the purpose of defraying the expenses of career and technical education teachers.

SECTION 16.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money in the State Treasury, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Mississippi State Board of Registered Professional Geologists for the period beginning July 1, 2022, and ending June 30, 2023 $   17,699.00.

     This additional appropriation is for the purpose of defraying the expenses related to accumulated leave payments.

SECTION 17.  In addition to all other sums herein appropriated, the following sum, or so much thereof as may be necessary, is appropriated out of any money to the credit of the Capital Expense Fund, and allocated in a manner as determined by the Treasurer's Office, to defray the expenses of the Mississippi Department of Information Technology Services for the period beginning upon passage of this act and

ending June 30, 2024............................. $ 5,500,000.00.

     This additional appropriation is for the purpose of defraying expenses related to the implementation of a state-owned private cloud environment.

     SECTION 18.  This act shall take effect and be in force from and after its passage.
