AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF ADAMS COUNTY, MISSISSIPPI, TO CONTRACT WITH A PRIVATE ENTITY TO PROVIDE CORRECTIONAL SERVICES TO ADAMS COUNTY FOR THE CONFINEMENT OF INMATES SUBJECT TO THE JURISDICTION OF ADAMS COUNTY INCLUDING THOSE AWAITING TRANSFER TO ANY OTHER JURISDICTION OR FACILITY; TO PROVIDE THAT IT SHALL BE LAWFUL FOR A CORRECTIONAL FACILITY OPERATED BY A PRIVATE ENTITY THAT HAS CONTRACTED WITH THE BOARD OF SUPERVISORS OF ADAMS COUNTY TO BE LOCATED IN ADAMS COUNTY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Adams County, Mississippi, is authorized and empowered, in its discretion, to contract with a private entity to provide correctional services to Adams County for the confinement of inmates subject to the jurisdiction of Adams County including those awaiting transfer to any other jurisdiction or facility.

     (2)  It shall be lawful for a correctional facility operated by a private entity that has contracted with the Board of Supervisors of Adams County pursuant to subsection (1) of this section, to be located in Adams County.  Any person confined in such a facility pursuant to the laws of the jurisdiction from which he is sent shall be considered lawfully confined in this state. 

     (3)  The private entity with whom the board of supervisors contracts pursuant to subsection (1) of this section shall be liable to the State of Mississippi and Adams County, Mississippi, for any illegal or tortuous actions of inmates confined in a facility operated by it.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
