Senate Bill 2759
AN ACT TO PROVIDE THAT THE GOVERNOR SHALL HAVE THE SOLE AUTHORITY TO ESTABLISH A STATE-BASED EXCHANGE PURSUANT TO THE FEDERAL PATIENT PROTECTION AND AFFORDABLE CARE ACT; TO PROVIDE THAT ANY SUCH EXCHANGE ESTABLISHED WITHOUT THE CONSENT OF THE GOVERNOR SHALL BE INVALID AND MUST BE DISCONTINUED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The Governor shall have the sole authority to establish a state-based exchange pursuant to the federal Patient Protection and Affordable Care Act (PPACA), Public Law 111-148. If such an exchange is established by any other officer, agency or institution of the State of Mississippi, or any instrumentality thereof, without the consent of the Governor, then the exchange shall be invalid and must be discontinued.
SECTION 2. This act shall take effect and be in force from and after its passage.
