Senate Bill 2185

AN ACT TO AMEND SECTION 73-25-35, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT COLLABORATIVE RELATIONSHIPS BETWEEN NURSE PRACTITIONERS AND LICENSED PHYSICIANS FOR PROVIDING SERVICES IN A MANAGED CARE SETTING SHALL BE APPROVED BY THE STATE BOARD OF MEDICAL LICENSURE UNDER WAIVERS IN CERTAIN HEALTH PROVIDER SETTINGS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 73-25-35, Mississippi Code of 1972, is amended as follows:

     73-25-35.  Registered nurses who are licensed and certified by the Mississippi Board of Nursing as nurse practitioners * * *are not prohibited from such nursing practice, but are entitled to engage therein without a physician's license. shall be authorized to practice through a collaborative relationship with a licensed physician approved by the State Board of Medical Licensure wherein patients are treated by the nurse practitioner shall receive a waiver from any distance requirement within the state from the primary office of the collaborative/consultative physician in the following settings:

          (a)  Emergency rooms;

          (b)  Intensive care units;

          (c)  Labor epidural services on obstetrical suites;

          (d)  State Department of Health services;

          (e)  State Department of Mental Health services and community mental health center services;

          (f)  Federally funded health systems, including Federally Qualified Health Centers (FQHCs), Veterans Affairs Medical Centers (VAMCs) and Rural Health Clinics (RHC);

          (g)  Managed Care Organizations serving Medicaid beneficiaries pursuant to Section 83-41-419.

     If a proposed written practice collaborative agreement for the practice of a certified nurse practitioner with a licensed physician in a managed care setting for Medicaid beneficiaries is denied by the State Board of Medical Licensure, the certified nurse practitioner shall have the right to appeal the decision disapproving the collaborative agreement to the Mississippi Division of Medicaid within thirty (30) days of the decision of denial, and the division shall be authorized to approve the collaborative agreement for the practice of said certified nurse practitioner.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2016.
