AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF LOWNDES COUNTY, MISSISSIPPI, TO CONTRIBUTE FUNDS TO ANY PUBLIC UTILITY OR ASSOCIATION OPERATING WITHIN THE COUNTY FOR PURPOSES OF EXPANDING OR REPAIRING WATER AND SEWER INFRASTRUCTURE; TO PROVIDE THAT SUCH CONTRIBUTION MAY BE MADE BY UTILIZING CERTAIN LOCAL FISCAL RECOVERY FUNDS THAT HAVE BEEN RECEIVED BY THE COUNTY THROUGH THE AMERICAN RESCUE PLAN ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Lowndes County, Mississippi, in its discretion, is authorized to contribute to any public utility or association operating within the county for purposes of expanding or repairing water and sewer infrastructure within the county, as authorized under this act.  The board of supervisors is authorized to contribute a portion of the Coronavirus State and Local Fiscal Recovery Funds of the American Rescue Plan Act (ARPA) that have been allocated to the county and converted to revenue loss funds to better assist with recovery from the COVID-19 pandemic and to meet specific needs within the county.  

     (2)  Pursuant to subsection (1) of this section, the board of supervisors is authorized to contribute to any public utility or association operating within Lowndes County for purposes of expanding or repairing water and sewer infrastructure within the county.  Such contributions may be made by utilizing the ARPA Local Fiscal Recovery Funds that have been converted to revenue loss funds in an amount not to exceed such available ARPA Local Fiscal Recovery Funds possessed by the county.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
