AN ACT MAKING APPROPRIATIONS FROM THE WORKING CASH-STABILIZATION RESERVE FUND TO THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO PROVIDE STATE FUNDS TO STATE AGENCIES TO REPLACE FEDERAL FUNDS THAT THOSE AGENCIES WOULD HAVE OTHERWISE RECEIVED FOR PAYING THE SALARIES OF EMPLOYEES OF THOSE AGENCIES WHOSE SALARIES ARE FULLY OR PARTIALLY PAID WITH FEDERAL FUNDS, BUT WHICH FEDERAL FUNDS ARE UNAVAILABLE BECAUSE OF THE PARTIAL SHUTDOWN OF THE FEDERAL GOVERNMENT; TO PROVIDE THAT EACH STATE AGENCY THAT RECEIVES FUNDS FROM THE DEPARTMENT UNDER THE PROVISIONS OF THIS ACT SHALL REPAY TO THE DEPARTMENT ALL OF THE FEDERAL FUNDS THAT THEY RECEIVE AFTER THE PARTIAL SHUTDOWN OF THE FEDERAL GOVERNMENT HAS BEEN FULLY RESOLVED THAT ARE RETROACTIVE PAYMENTS OF THE FEDERAL FUNDS THAT THE AGENCY WOULD HAVE OTHERWISE RECEIVED FOR PAYING THE SALARIES OF EMPLOYEES OF THOSE AGENCIES WHOSE SALARIES ARE FULLY OR PARTIALLY PAID WITH FEDERAL FUNDS DURING THE PERIOD OF THE PARTIAL SHUTDOWN OF THE FEDERAL GOVERNMENT; TO PROVIDE THAT UPON RECEIPT OF REPAYMENTS OF THOSE FUNDS FROM STATE AGENCIES, THE DEPARTMENT SHALL DEPOSIT THOSE FUNDS INTO THE WORKING CASH-STABILIZATION RESERVE FUND.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  The following sum, or so much of it as may be necessary, is appropriated out of any money in the State Treasury to the credit of the Working Cash-Stabilization Reserve Fund, to the Department of Finance and Administration to be expended for the purposes described in Section 2 of this act, for the period beginning upon the passage of this act and ending June 30, 2019...........................................

     SECTION 2.  The money appropriated by Section 1 of this act shall be expended by the Department of Finance and Administration to provide state funds to state agencies to replace federal funds that those agencies would have otherwise received for paying the salaries of employees of those agencies whose salaries are fully or partially paid with federal funds, but which federal funds are unavailable because of the partial shutdown of the federal government that began on December 22, 2018, as a result of the failure of the United States Congress to enact certain appropriation measures.

     SECTION 3.  The Department of Finance and Administration is authorized to transfer funds appropriated to the department by this act to state agencies as necessary to replace federal funds that those agencies would have otherwise received for paying the salaries of employees of those agencies whose salaries are fully or partially paid with federal funds that are not available during the period of the partial shutdown of the federal government.

     SECTION 4.  As a condition of receiving the funds appropriated by this act, each state agency that receives funds from the Department of Finance and Administration under the provisions of this act shall repay to the department all of the federal funds that they receive after the partial shutdown of the federal government has been fully resolved that are retroactive payments of the federal funds that the agency would have otherwise received for paying the salaries of employees of those agencies whose salaries are fully or partially paid with federal funds during the period of the partial shutdown of the federal government.  Upon receipt of repayments of those funds from state agencies, the department shall deposit those funds into the Working Cash-Stabilization Reserve Fund.

     SECTION 5.  The money appropriated by this act shall be paid by the State Treasurer out of any money in the State Treasury to the credit of the Working Cash-Stabilization Reserve Fund, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 6.  This act shall take effect and be in force from and after its passage.
