House Bill 1309

AN ACT TO AUTHORIZE CERTAIN PERSONS TO GROW A CERTAIN AMOUNT OF MEDICAL MARIJUANA FOR THEIR OWN PERSONAL USE IF MEDICAL MARIJUANA IS AUTHORIZED FOR USE IN THE STATE OF MISSISSIPPI; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  If medical marijuana is authorized for use in the State of Mississippi, any person who has a documented diagnosis by a medical doctor for cancer or Parkinson's disease, or is a current or former member of the military who is diagnosed by a medical doctor to have post traumatic stress disorder, may grow no more than six (6) plants of marijuana for his or her personal use on his or her own property.

     (2)  Any such person must obtain a permit from the licensing agency for Fifty Dollars ($50.00) per year, and in order to renew such permit, the person must provide an annual report of testing to determine the level of THC in the person's bloodstream.

     (3)  The area in which the person grows marijuana must be owned by such person, and must be at least one-half (1/2) acre in size.

     (4)  All medical marijuana grown by such person shall remain on his or her property, and such person shall not sell or transfer the marijuana to any other person.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2022.
