House Bill 1285

AN ACT TO AMEND SECTION 57-39-111, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE LEGISLATIVE BUDGET OFFICE SHALL NOT CONSIDER THE BUDGET OF ANY STATE AGENCY THAT HAS NOT MET THE ENERGY CONSUMPTION REDUCTION GOALS IN THIS SECTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 57-39-111, Mississippi Code of 1972, is amended as follows:

     57-39-111.  (1)  A state agency shall annually submit a detailed energy management plan to the division in the form as prescribed by the division.  The detailed energy management plan shall describe specific measures to be taken to reduce the agency's energy consumption by energy unit measure in fiscal year 2009 by a minimum of fifteen percent (15%) as compared with its energy consumption in fiscal year 2007.  The plan shall also describe specific measures to be taken to reduce the agency's energy consumption by energy unit measure in fiscal year 2010 by a minimum of ten percent (10%) as compared with its energy consumption in fiscal year 2009 and to maintain or reduce that level of energy consumption with adjustments for agency growth or reduction and seasonal variances.  If the detailed energy management plan meets the criteria developed by the division, the division shall approve the plan.  If the detailed energy management plan fails to meet the criteria, the division shall disapprove the detailed energy management plan and notify the submitting agency in writing including the reasons for disapproval.

     (2)  Before September 1 of each year, the division shall notify the Legislative Budget Office in writing of those agencies failing to have an approved detailed energy management plan.  The Legislative Budget Office shall not consider the budget of any state agency that does not have an approved, detailed energy management plan filed with the division or has not met the energy consumption reduction goals described in this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
