AN ACT TO PROVIDE THAT THE STATE DEPARTMENT OF HEALTH SHALL ESTABLISH AN INCENTIVE GRANT PROGRAM TO PROVIDE PAYMENTS TO SPECIALTY HEALTH CARE PROVIDERS AS INCENTIVES FOR THEM TO BE AVAILABLE TO PROVIDE THEIR SERVICES TO RURAL OR SMALLER HOSPITALS WHEN LARGER HOSPITALS HAVE COMMUNICATED TO EMERGENCY MEDICAL SERVICES PERSONNEL THAT THEY ARE ON DIVERSION STATUS AND CANNOT SAFELY ACCEPT ANY NEW PATIENTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The State Department of Health shall establish an incentive grant program, with funds appropriated to the department for that purpose, to provide payments to specialty physicians and other specialty health care providers as incentives for them to be available to provide their services to rural or smaller hospitals when larger hospitals have communicated to emergency medical services personnel that they are on diversion status and cannot safely accept any new patients.  The department shall make outreach efforts to make health care providers aware of the incentive grants provided by the program, and shall maintain a an easily accessible list of the health care providers that participate in the program for rural or smaller hospitals that need the services of those providers.

     (2)  The department shall adopt rules and regulations governing the program, including the criteria for receipt of the grants, the application process for the grants, and the maximum amount of the grants.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
