AN ACT TO REQUIRE THE DEPARTMENT OF REVENUE TO STUDY AND PREPARE A REPORT RELATING TO SALES TAX EXEMPTIONS AUTHORIZED WITH REGARD TO VARIOUS NONPROFIT ORGANIZATIONS; TO REQUIRE THE DEPARTMENT OF REVENUE TO FILE A COPY OF ITS REPORT NOT LATER THAN JANUARY 1, 2012, WITH THE GOVERNOR, THE CLERK OF THE HOUSE OF REPRESENTATIVES, THE SECRETARY OF THE SENATE, THE CHAIRMAN OF THE HOUSE WAYS AND MEANS COMMITTEE AND THE CHAIRMAN OF THE SENATE FINANCE COMMITTEE; AND FOR RELATED PURPOSES. 

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Revenue shall study and prepare a report relating to the sales tax exemptions authorized with regard to various nonprofit organizations under Section 27-65-1 et seq.  The study and report will address:  (a) the impact, if any, the exemptions have had in assisting the organizations perform the purposes for which they were established; (b) whether the organizations need the exemptions in order to remain financially viable and able to perform the purposes for which they were established; (c) the effect of the exemptions on sales tax revenue; and (d) any other matters the department determines to be appropriate. 

     (2)  The Department of Revenue shall file a copy of its report not later than January 1, 2012, with the Governor, the Clerk of the House of Representatives, the Secretary of the Senate and the Chairmen of the House Ways and Means Committee and the Senate Finance Committee.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
