House Bill 1109

AN ACT TO AUTHORIZE COUNTIES TO SPEND THEIR ARPA FUNDS THAT ARE ALLOCATED TO THE REVENUE LOSS ELIGIBLE USE CATEGORY TO PROVIDE DIRECT ASSISTANCE TO RURAL WATER ASSOCIATION AND OTHER WATER AND/OR SEWER AUTHORITIES PROVIDING SERVICES IN THE COUNTY FOR THE COSTS OF WATER AND/OR SEWER PROJECTS OF THOSE ASSOCIATIONS AND AUTHORITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The board of supervisors of a county may expend any of the portion of the funds received by the county directly from the federal Coronavirus Local Fiscal Recovery Fund under the American Rescue Plan Act (ARPA) that are allocated to the revenue loss eligible use category for those funds, to provide direct assistance to rural water association and other water and/or sewer authorities providing services in the county, separately from the state programs created in Sections 41-3-16.1 and 49-2-131, for the costs of water and/or sewer projects of those associations and authorities.  For the purposes of expenditures from the revenue loss eligible use category, expenditures by the county for the purposes described in this section shall be considered to be expenditures for government services.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
