An Act Relating To The Administration Of The Mississippi Medicaid Law; To Amend Section 43-13-107, Mississippi Code Of 1972, To Exempt The Division Of Medicaid From The Rules Of The State Personnel Board; To Change The Membership And Duties Of The Medical Care Advisory Committee To Conform To Federal Law; To Change The Meeting Requirements Of The Drug Use Review Board To Conform To Federal Law; To Change The Meeting Requirements Of The Pharmacy And Therapeutics Committee To Conform To Federal Law; And To Delete The Repealer On The Section; To Amend Section 43-13-117, Mississippi Code Of 1972, To Authorize The Division To Operate The Medicaid Program As Authorized By Federal Regulations; To Delete Provisions For Specific Health Care Services To Be Reimbursed Under The Medicaid Program; To Authorize The Division To Reimburse Inpatient Hospital Services Using Apr-drg Payment Methodology And Outpatient Hospital Services Using An Apc Payment Methodology; To Retain The Language Providing State Share Matching Funds For Mental Health Services; To Require The Division To Review The Effectiveness Of Its Services And Payments By December 31, 2014, And Every Two Years Thereafter; To Amend Section 43-13-121, Mississippi Code Of 1972, To Allow The Division To Retain Legal Counsel Without Approval Of The Attorney General; To Exempt The Division From The Requirements Of The Administrative Procedures Law And To Only Follow Federal Requirements When Enacting State Plan Amendments; To Authorize The Division To Collect Overpayments To Providers Upon 30 Days Notice Before The Conclusion Of An Appeal; To Amend Section 43-13-145, Mississippi Code Of 1972, To Extend The Hospital Assessment Past Fiscal Year 2012 And Delete The Repealer On The Assessment; To Authorize The Division To Reimburse Free Standing Psychiatric Hospitals Based Upon An Apr-drg Reimbursement Methodology; To Remove The Requirement That Hospitals Receive The Annual Market Basket Payment Increases; To Bring Forward Section 43-13-317, Mississippi Code Of 1972; To Amend Sections 7-5-1, 7-5-39 And 27-104-105, Mississippi Code Of 1972, To Conform To The Preceding Provisions; And For Related Purposes.
