JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to article III of the Constitution of Missouri, and adopting one new section relating to a fair ballot commission.




Be it resolved by the House of Representatives, the Senate concurring therein:


            That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2012, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article III of the Constitution of the state of Missouri:

            Section A. Article III, Constitution of Missouri, is amended by adding one new section, to be known as section 54, to read as follows:

            Section 54. There is hereby established a Fair Ballot Commission, to be composed of two members of the house of representatives appointed by the speaker of the house of representatives, two members of the house of representatives appointed by the minority floor leader of the house of representatives, two members of the senate appointed by the president pro tem of the senate, and two members of the senate appointed by the minority floor leader of the senate.

            The fair ballot commission shall be in charge of determining the propriety and correctness of all proposed ballot language, whether submitted by the initiative or by referendum. Any proposed ballot language shall be submitted to the commission for its approval or rejection. Upon recommendation by an affirmative vote of at least five members of the commission, approved ballot language shall be submitted to the secretary of state, who shall submit the approved ballot language to the voters without subsequent change. If the proposed ballot language is not approved by the commission, the commission may consider providing alternative language to the secretary of state upon recommendation by an affirmative vote of at least five members of the commission.

            Members of the commission shall be reimbursed for their actual and necessary expenses incurred in the performance of their duties.
