AN ACT

To repeal section 167.223, RSMo, and to enact in lieu thereof two new sections relating to virtual education.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 167.223, RSMo, is repealed and two new sections enacted in lieu thereof, to be known as sections 167.223 and 167.360, to read as follows:

            167.223. 1. Public high schools may, in cooperation with Missouri public community colleges and public or private four-year colleges and universities, offer postsecondary course options to high school students, including virtual courses. A postsecondary course option allows eligible students to attend vocational or academic classes on a college or university campus and receive both high school and college credit upon successful completion of the course. The department of higher education in conjunction with the department of elementary and secondary education shall jointly develop a "best practices" policy for postsecondary courses delivered virtually under this section for use beginning with the 2014-15 academic year. The guidelines shall include, at a minimum, expectations for instructor training in on-line course delivery, privacy issues, computer system requirements, and technical support.

            2. For purposes of state aid, the pupil's resident district shall continue to count the pupil in the average daily attendance of such resident district for any time the student is attending a postsecondary course.

            3. Any pupil enrolled in a community college under a postsecondary course option shall be considered a resident student for the purposes of calculating state aid to the community college.

            4. Community colleges and four-year colleges and universities may charge reasonable fees for pupils enrolled in courses under a postsecondary course option. Such fees may be paid by the district of residence or by the pupil, as determined by the agreement between the district of residence and the college or university.

            167.360. 1. A course used for remediation or credit recovery may be delivered virtually through the state's virtual instruction program under section 161.670 or through a district's or charter school's virtual program under section 162.1250 if both the instructor and the course meet the requirements of the applicable section.

            2. Each school district or charter school that provides a virtual program or course shall monitor the submission of written work and the taking of tests used for a course grade sufficiently to provide assurance that the work submitted on-line by a student in the virtual program or course is the work of the student who is enrolled in the program or course. A district that offers a program or course to students who live outside a reasonable driving distance to a district building to complete a proctored assessment shall provide a procedure through policy that includes reasonable safeguards for academic integrity.

            3. A district or charter school that contracts for a virtual program or course shall ensure that the contractor meets the requirements of this section.
