AN ACT

To amend chapter 306, RSMo, by adding thereto one new section relating to prohibiting exceeding certain noise levels on the Lake of the Ozarks, with a penalty provision.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 306, RSMo, is amended by adding thereto one new section, to be known as section 306.108, to read as follows:

            306.108. 1. It shall be unlawful for any person to make, continue, or allow to be made or continued any noise that can be heard on the Lake of the Ozarks, which when measured from a distance of fifty feet or more exceeds eighty decibels on an A-weighted scale during the hours of 7:01 a.m. to 10:00 p.m., or exceeds seventy decibels during the hours of 10:01 p.m. to 7:00 a.m.

            2. Any person who violates the provisions of this section shall be punished by imprisonment not to exceed ninety days or a fine up to five hundred dollars or both imprisonment and a fine.
