AN ACT

To amend chapter 208, RSMo, by adding thereto one new section relating to MO HealthNet benefit requirements.

Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 208, RSMo, is amended by adding thereto one new section, to be known as section 208.186, to read as follows:

            208.186. All recipients of MO HealthNet benefits who have been convicted of a crime involving drug use, including but not limited to those crimes under chapter 195, shall be ordered by the court to enroll and participate in a drug treatment program in order to continue receiving MO HealthNet benefits. The director of the department of health and senior services shall apply to the United States Secretary of Health and Human Services for all waivers of requirements under federal law that may be necessary to implement the provisions of this section with full federal participation. The provisions of this section shall be implemented, subject to appropriation, as waivers necessary to ensure continued federal participation are received.
