AN ACT
To repeal sections 178.540, 178.550, 178.560, and 178.585, RSMo, and to enact in lieu thereof four new sections relating to career and technical education.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Sections 178.540, 178.550, 178.560, and 178.585, RSMo, are repealed and four new sections enacted in lieu thereof, to be known as sections 178.540, 178.550, 178.560, and 178.585, to read as follows:
178.540. The [state commissioner of education is the executive officer of the state board for the administration of] career and technical education board shall administer sections 178.420 to 178.580 for the state board of education. [He] The career and technical education board shall appoint[, with the approval of the board,] the assistants that are necessary to properly carry out the provisions of sections 178.420 to 178.580.
178.550. [The president of the state board of education shall annually appoint a committee of five members to be known as the "State Advisory Committee for Vocational Education". The state advisory committee shall consist of one person of experience in agriculture; one employer; one representative of labor; one person of experience in home economics; one person of experience in commerce. The state commissioner of education is ex officio a member and the chairman of the advisory committee. The state board of education shall formulate general principles and policies for the administration of sections 178.420 to 178.580, which, when they have been approved by the state advisory committee, shall be put into effect. Joint conferences between the state board of education and advisory committee shall be held at least four times each year. All members of the state advisory committee shall be reimbursed for their actual expenses in attending the conferences.] 1. This section shall be known and may be cited as the "Career and Technical Education Student Protection Act". There is hereby established the "Career and Technical Education Board", which shall constitute a body corporate and politic. The board shall oversee and coordinate career and technical education and career and technical education student organizations' activities in Missouri.
2. The board shall be composed of nine members who shall be Missouri residents, appointed by the governor with the advice and consent of the senate:
(1) A director or administrator of a career and technical education center;
(2) An individual from the business community with a background in commerce;
(3) A career and technical education teacher who also serves as an advisor to a career and technical education student organization;
(4) A career and technical education professor or instructor employed at a community college or at Linn State Technical College;
(5) Three members selected from school staff who are advisors to any chapter of any of the nationally-recognized organizations of:
(a) DECA;
(b) Future Business Leaders of America (FBLA);
(c) FFA;
(d) Family, Career and Community Leaders of America (FCCLA);
(e) Health Occupations Students of America (HOSA);
(f) SkillsUSA; or
(g) Technology Student Association (TSA);
(6) A member currently serving on a local school board;
(7) A superintendent or administrator of a school district who is not a career and technical education administrator.
3. Members shall serve a term of five years except for the initial appointments, which shall be for the following lengths:
(1) One member shall be appointed for a term of one year;
(2) Two members shall be appointed for a term of two years;
(3) Two members shall be appointed for a term of three years;
(4) Two members shall be appointed for a term of four years;
(5) Two members shall be appointed for a term of five years.
4. One member of the state board of education, as selected by the state board of education, shall serve as an ex officio member of the board. He or she shall attend all meetings of the board. The assistant commissioner for the office of college and career readiness of the department of elementary and secondary education shall serve as executive director of the career and technical education board. Any other employees of the state board of education and department of elementary and secondary education assigned to work in the areas of career and technical education shall report to the career and technical education board.
5. The board shall meet at least four times annually. The board may make all rules it deems necessary to enable it to conduct its meetings, elect its officers, and set the terms and duties of its officers. The board shall elect from amongst its members a chairperson, vice chairperson, a secretary-reporter, and such other officers as it deems necessary. Members of the board shall serve without compensation but may be reimbursed for actual expenses necessary to the performance of their official duties for the board.
6. The business to come before the board shall be available on the board's internet website at least seven business days prior to the start of each meeting. All records of any decisions, votes, exhibits, or outcomes shall be available on the board's internet website within forty-eight hours following the conclusion of every meeting. Any materials prepared for the members of the board by the staff shall be delivered to the members at least five days before the meeting, and to the extent such materials are public records as defined in section 610.010 and are not permitted to be closed under section 610.021, shall be made available on the board's internet website at least five business days in advance of the meeting.
7. The board shall have the authority and be responsible for developing, implementing, and administering the budget for career and technical education for the state board of education and department of elementary and secondary education. All authority of the commissioner of education and department of elementary and secondary education to administer the budget for career and technical education is hereby transferred to the board. The executive director of the board shall personally appear before the budget committee of the house of representatives and the appropriations committee of the senate when making the annual budget request.
8. The board shall have the power to:
(1) Develop a comprehensive statewide long-range strategic plan for career and technical education;
(2) Confer with public and private entities for the purpose of promoting and improving career and technical education within this state;
(3) Identify legislative recommendations to improve career and technical education;
(4) Promote coordination of existing career and technical education programs;
(5) Identify service gaps and provide advice on methods to close such gaps;
(6) Apply for and accept gifts, grants, appropriations, loans, or contributions to the board from any source, public or private, and enter into contracts or other transactions with any federal or state agency, any private organizations, or any other source in furtherance of the purpose of this section, and take any and all actions necessary to avail itself of such aid and cooperation, provided such aid does not violate the first amendment to the United States Constitution, or section 7 of article I or section 8 of article IX of the Missouri Constitution;
(7) Direct disbursements from the career and technical education board fund as provided in this section;
(8) Administer the career and technical education board fund;
(9) Purchase, receive, take by grant, gift, devise, bequest or otherwise, lease, or otherwise acquire, own, hold, improve, employ, use, and otherwise deal with real or personal property or any interests therein, wherever situated;
(10) Sell, convey, lease, exchange, transfer, or otherwise dispose of all or any of its property or any interest therein, wherever situated;
(11) Employ and fix the compensation of an executive director and such other agents or employees as it considers necessary;
(12) Adopt, alter, or repeal by its own bylaws, rules, and regulations governing the manner in which its business may be transacted;
(13) Adopt and use an official seal;
(14) Assess or charge fees as the board determines to be reasonable to carry out its purposes;
(15) Make all expenditures which are incident and necessary to carry out its purposes;
(16) Sue and be sued in its official name; and
(17) Take such action, enter into such agreements, and exercise all functions necessary or appropriate to carry out the duties and purposes set forth in this section.
9. There is hereby created the "Career and Technical Education Board Fund", which shall consist of money collected under this section. The board shall administer the fund. The state treasurer shall be custodian of the fund. In accordance with sections 30.170 and 30.180, the state treasurer may approve disbursements. The fund shall be a dedicated fund and, upon appropriation, money in the fund shall be used solely for the administration of this section. Notwithstanding the provisions of section 33.080, to the contrary, any moneys remaining in the fund at the end of the biennium shall not revert to the credit of the general revenue fund. The state treasurer shall invest moneys in the fund in the same manner as other funds are invested. Any interest and moneys earned on such investments shall be credited to the fund.
10. For purposes of this section, "board" shall mean the career and technical education board.
178.560. The school board of any school district or the governing board of Linn State Technical College maintaining a prevocational or vocational school, Linn State Technical College, department or class receiving the benefit of state or federal moneys under the provisions of sections 178.420 to 178.580, as a condition of approval by the state board of education [and the state commissioner of education], shall appoint persons of experience in agriculture, industry, home economics and commerce to give advice and assistance to the school board or governing board in the establishment and maintenance of the schools, departments and classes. The persons of experience shall serve without compensation.
178.585. 1. Under rules and regulations of the state board of education, the [commissioner of education] career and technical education board, in cooperation with the director of the division of workforce development of the department of economic development, shall establish procedures to provide grants to public high schools, vocational-technical schools, Linn State Technical College, and community colleges solely for the purpose of new programs, curriculum enhancement, equipment and facilities so as to upgrade vocational and technical education in the state.
2. Each vocational-technical school, community college, Linn State Technical College, and school district of any public high school receiving a grant authorized by this section shall have an advisory committee composed of local business persons, labor leaders, parents, senior citizens, community leaders and teachers to establish a plan to ensure that students who graduate from the vocational-technical school, community college, Linn State Technical College, or public high school proceed to a four-year college or high-wage job with workplace-skill development opportunities.
3. The director of the department of economic development shall provide annually to the [commissioner of education] state board of education and the career and technical education board a listing of demand occupations in the state including substate projections. The listing shall include those occupations for which, in the judgment of the director of the department of economic development, there is a critical shortage to meet present or future employment needs necessary to the economic growth and competitiveness of the state.
4. In any fiscal year, at least seventy-five percent of all moneys for the grant awards authorized by this section shall be to public high schools, vocational-technical schools, Linn State Technical College, or community colleges for new programs, curriculum enhancement or equipment necessary to address demand occupations identified pursuant to subsection 3 of this section.
