AN ACT
To amend chapter 393, RSMo, by adding thereto one new section relating to a nuclear power surcharge.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 393, RSMo, is amended by adding thereto one new section, to be known as section 393.293, to read as follows:
393.293. Notwithstanding any other provision of law to the contrary, an electrical corporation engaged within this state in the production of electricity utilizing nuclear energy shall pay a surcharge of one-tenth of one cent per kilowatt hour of nuclear energy produced and is sold out of its service territory. The surcharge may be recoverable by the electrical corporation through normal rate making procedures. Any money received under this section shall be placed in a special fund in the general revenue fund and shall be distributed to school districts within the ten-mile emergency planning zone, as defined by the federal Emergency Management Agency. All distributions shall be on a percentage basis to each school district based on the percentage of land within the ten-mile emergency planning zone that falls within each school district. The money shall be distributed for nuclear emergency preparedness and planning and hazard mitigation, as determined by the school district receiving such money.
