AN ACT

To amend chapter 313, RSMo, by adding thereto one new section relating to sweepstakes terminal devices.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 313, RSMo, is amended by adding thereto one new section, to be known as section 313.900, to read as follows:

            313.900. 1. As used in this section, the following terms mean:

            (1) "Charitable organization", any organization recognized as tax-exempt under federal law for charitable or religious purposes. The term includes fraternal organizations, religious organizations, service organizations, and veterans organizations which have been exempted from payment of federal income tax as provided in Section 501(c) of the Internal Revenue Code of 1986, as amended;

            (2) "Sweepstakes", any game, contest, or promotion in which a person obtains an entry to win or become eligible to receive a prize based upon an element of chance;

            (3) "Sweepstakes terminal device", a mechanical, video, digital, or electronic machine or device, including a central terminal, that is owned, leased, or otherwise possessed by a charitable organization and capable of displaying sweepstakes information on a screen or other mechanism.

            2. Any charitable organization may sponsor raffles and sweepstakes under Article III, Section 39(f) of the Constitution of Missouri and this section.

            3. Sweepstakes may be conducted by sweepstakes terminal devices if they are located on the premises of a charitable organization. A sweepstakes may offer entries in proportion to contributions made to the charitable organization, provided, however, that an alternative method of entry is available where a person can obtain a chance to win without providing anything of value in return for the right to participate. A sweepstakes terminal device may display the prizes awarded by the sweepstakes through simulated casino-type games. Such simulations shall be for entertainment purposes only and shall have no effect on the chances to win.
