AN ACT
To amend chapter 228, RSMo, by adding thereto one new section relating to the improvement and maintenance of private roads.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 228, RSMo, is amended by adding thereto one new section, to be known as section 228.375, to read as follows:
228.375. 1. Notwithstanding any other law, in the absence of any other agreement for the maintenance of a private road, including covenants, requirements contained in deeds, and state or local permits, the owners of property abutting a private road and the holder of recorded easement with a right to use a private road shall equally divide the cost of maintaining the road.
2. Developers of subdivisions or plots with multiple houses shall attach a covenant assigning maintenance of any private road within that development to the property owners of such development.
3. For purposes of this section, "private road" means any road established under this chapter or by easement where the owner is not the United States or an agency of instrumentality thereof, or the state of Missouri, or any county, municipality, political subdivision or special district, instrumentality, or agency of the state of Missouri.
