1.1A bill for an act
1.2relating to motor vehicles; establishing a special Pedal Minnesota license plate;
1.3providing for bicycle safety donations and grants; requiring reports;amending
1.4Minnesota Statutes 2012, sections 168.013, subdivision 22; 168.1293, by adding
1.5subdivisions; proposing coding for new law in Minnesota Statutes, chapters
1.6168; 174.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2012, section 168.013, subdivision 22, is amended to read:
1.9    Subd. 22. Optional donation for education on anatomical gifts donations. (a)
1.10As part of procedures for payment of the vehicle registration tax under this section, the
1.11commissioner shall allow a vehicle owner to add to the tax:
1.12(1) a $2 donation for the purposes of public information and education on anatomical
1.13gifts under section 171.075, for; and
1.14(2) a donation in an amount determined by the vehicle owner for bicycle safety
1.15programs under section 174.38.
1.16(b) This subdivision applies only to in-person transactions conducted by a deputy
1.17registrar appointed under section 168.33, subdivision 2. This subdivision applies, and to
1.18annual renewal registrations only, and. It does not apply to registrations authorized under
1.19sections 168.053 to 168.057, 168.127, 168.187, and 168.27.

1.20    Sec. 2. Minnesota Statutes 2012, section 168.1293, is amended by adding a subdivision
1.21to read:
1.22    Subd. 8. Record keeping. The commissioner shall maintain a record of the number
1.23of each type of special plate issued under this chapter.

2.1    Sec. 3. Minnesota Statutes 2012, section 168.1293, is amended by adding a subdivision
2.2to read:
2.3    Subd. 9. Legislative report. (a) By November 15 of each year, the commissioner
2.4shall submit a report on special plates to the chairs and ranking minority members of the
2.5legislative committees with jurisdiction over transportation policy and finance.
2.6(b) The report must, at a minimum, specify:
2.7(1) for each type of special plate issued under this chapter, the number issued in the
2.8last previous fiscal year and since inception of the plate; and
2.9(2) for each type of special plate that requires an additional contribution under
2.10this chapter, the amount of contribution funds received in the last previous fiscal year
2.11and since inception of the plate, and a brief description of the primary expenditures and
2.12usage of contribution funds.
2.13(c) Any department or agency receiving contribution funds in association with
2.14special plates shall assist the commissioner, as requested, in preparing the report required
2.15by this subdivision.
2.16EFFECTIVE DATE.This section is effective the day following final enactment.

2.17    Sec. 4. [168.1299] SPECIAL PEDAL MINNESOTA PLATES.
2.18    Subdivision 1. Issuance. The commissioner shall issue special Pedal Minnesota
2.19plates, or a single motorcycle plate, to an applicant who:
2.20(1) is a registered owner of a passenger automobile, one-ton pickup truck,
2.21motorcycle, or recreational motor vehicle;
2.22(2) pays a fee of $10 for each set of plates, along with any other fees required by
2.23this chapter;
2.24(3) pays the registration tax as required under section 168.013;
2.25(4) complies with this chapter and rules governing registration of motor vehicles; and
2.26(5) makes an annual contribution of at least $30 to the bicycle safety and information
2.27account.
2.28    Subd. 2. Design. After consultation with interested groups, the commissioner shall
2.29design the special plate to contain the inscription "Pedal Minnesota."
2.30    Subd. 3. No refund. Contributions under this section must not be refunded.
2.31    Subd. 4. Plates transfer. On application to the commissioner and payment of a
2.32transfer fee of $5, the registered owner of a vehicle bearing the special plates may transfer
2.33the plates to another motor vehicle if the subsequent vehicle is:
2.34(1) qualified under subdivision 1, clause (1), to bear the special plates; and
2.35(2) registered to the same individual to whom the special plates were originally issued.
3.1    Subd. 5. Exemption. Special plates issued under this section are not subject to
3.2section 168.1293, subdivision 2.
3.3    Subd. 6. Contribution. (a) The application for a special plate under this section must
3.4indicate that the contribution specified under subdivision 1, clause (5), is a minimum annual
3.5contribution to receive the plates, and that the applicant may make additional contributions.
3.6(b) Funds from the contribution under subdivision 1, clause (5), must be deposited in
3.7the bicycle safety and information account established in section 174.38, subdivision 1.
3.8EFFECTIVE DATE.This section is effective January 1, 2014, for special Pedal
3.9Minnesota plates issued on or after that date.

3.10    Sec. 5. [174.38] BICYCLE SAFETY.
3.11    Subdivision 1. Bicycle safety and information account. (a) A bicycle safety and
3.12information account is established in the special revenue fund. The account consists of
3.13funds contributed under sections 168.013, subdivision 22, and 168.1299, and any other
3.14money donated, allotted, transferred, or otherwise provided to the account.
3.15(b) Money in the account is annually appropriated to the commissioner of
3.16transportation for the purposes specified in subdivision 2, except that an amount equal to
3.17the total cost associated with the development and issuance of the special plates under
3.18section 168.1299 and with optional donations under section 168.013, subdivision 22, is
3.19first appropriated to the commissioner of public safety.
3.20    Subd. 2. Bicycle safety and education; grants. (a) The commissioner shall,
3.21in consultation with the advisory committee on nonmotorized transportation, develop
3.22and implement a grantmaking process to annually allocate funds in the bicycle safety
3.23and information account. The grantmaking process shall specify, but is not limited to,
3.24eligibility criteria, application and grant decision-making procedures, and allowable usage
3.25of grant funds.
3.26(b) The commissioner shall annually provide at least 50 percent of available funds as
3.27grants to eligible recipients, and may use the remaining funds for:
3.28(1) program administration; and
3.29(2) bicycle safety, awareness, information, or education.
3.30(c) The commissioner shall provide grants to an organization that:
3.31(1) is a charitable entity under section 501(c)(3) of the Internal Revenue Code, as
3.32defined in section 289A.02, subdivision 7; and
3.33(2) has a mission or primary goal that includes bicycle safety, awareness,
3.34information, or education.
4.1(d) From a grant under this section, a recipient shall provide resources and
4.2implement programs designed to improve bicycle safety and awareness.
4.3EFFECTIVE DATE.This section is effective July 1, 2013.
