1.1A bill for an act
1.2relating to state lands; establishing adopt-a-WMA program; adding to and
1.3deleting from state parks, state recreation areas, state forests, and state wildlife
1.4management areas; authorizing public and private sales of certain surplus
1.5and tax-forfeited lands;amending Minnesota Statutes 2010, sections 85.052,
1.6subdivision 4; 89.021, subdivision 48; proposing coding for new law in
1.7Minnesota Statutes, chapter 97A.
1.8BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.9    Section 1. Minnesota Statutes 2010, section 85.052, subdivision 4, is amended to read:
1.10    Subd. 4. Deposit of fees. (a) Fees paid for providing contracted products and
1.11services within a state park, state recreation area, or wayside, and for special state park
1.12uses under this section shall be deposited in the natural resources fund and credited to a
1.13state parks account.
1.14(b) Gross receipts derived from sales, rentals, or leases of natural resources within
1.15state parks, recreation areas, and waysides, other than those on trust fund lands, must be
1.16deposited in the state treasury and credited to the state parks working capital account.
1.17The appropriation under section 85.22 for revenue deposited in this section is limited to
1.18$25,000 per fiscal year.
1.19(c) Notwithstanding paragraph (b), the gross receipts from the sale of stockpile
1.20materials, aggregate, or other earth materials from the Iron Range Off-Highway Vehicle
1.21Recreation Area shall be deposited in the dedicated accounts in the natural resources fund
1.22from which the purchase of the stockpile material was made. Notwithstanding paragraph
1.23(b), the payments made under section 93.22, subdivision 1, paragraph (c), pursuant to a
1.24state mineral lease on lands and mineral rights purchased for and within the Iron Range
2.1Off-Highway Vehicle Recreation Area shall be deposited in the dedicated accounts in the
2.2natural resources fund from which the purchase of the lands was made.

2.3    Sec. 2. Minnesota Statutes 2010, section 89.021, subdivision 48, is amended to read:
2.4    Subd. 48. Smokey Smoky Hills State Forest.

2.5    Sec. 3. [97A.134] ADOPT-A-WMA PROGRAM.
2.6    Subdivision 1. Creation. The Minnesota adopt-a-WMA (wildlife management area)
2.7program is established. The commissioner shall coordinate the program through the
2.8regional offices of the Department of Natural Resources.
2.9    Subd. 2. Purpose. The purpose of the program is to encourage sporting, outdoor,
2.10business, and civic groups or individuals to assist, on a volunteer basis, in improving and
2.11maintaining wildlife management areas.
2.12    Subd. 3. Agreements. (a) The commissioner shall enter into informal agreements
2.13with sporting, outdoor, business, and civic groups or individuals for volunteer services to
2.14maintain and make improvements to real property on state wildlife management areas in
2.15accordance with plans devised by the commissioner after consultation with the groups
2.16or individuals.
2.17(b) The commissioner may erect appropriate signs to recognize and express
2.18appreciation to groups and individuals providing volunteer services under the
2.19adopt-a-WMA program.
2.20(c) The commissioner may provide assistance to enhance the comfort and safety of
2.21volunteers and to facilitate the implementation and administration of the adopt-a-WMA
2.22program.

2.23    Sec. 4. ADDITIONS TO STATE PARKS.
2.24    Subdivision 1. [85.012] [Subd. 52.] Scenic State Park, Itasca County. The
2.25following areas are added to Scenic State Park, Itasca County:
2.26(1) the Southwest Quarter of the Southeast Quarter, Section 1, Township 60 North,
2.27Range 26 West, lying south of Scenic Highway; and
2.28(2) Government Lot 18, Section 1, Township 60 North, Range 26 West, lying south
2.29of Scenic Highway.
2.30    Subd. 2. [85.012] [Subd. 60.] William O'Brien State Park, Washington County.
2.31The following area is added to William O'Brien State Park, Washington County: that part
2.32of the Southwest Quarter of the Southwest Quarter, Section 36, Township 32 North, Range
2.3320 West, lying South of the so-called Marine Mills and Chisago City Road, which runs
3.1over and across said tract, containing 13 acres, more or less, SUBJECT to right-of-way of
3.2County Highway No. 4.

3.3    Sec. 5. DELETION TO STATE PARK.
3.4[85.012] [Subd. 26.] Hayes Lake State Park, Roseau County. The following area
3.5is deleted from Hayes Lake State Park: That part of the Northeast Quarter of Section 32,
3.6Township 160, Range 38, Roseau County, Minnesota, described as follows: Commencing
3.7at the northwest corner of said Northeast Quarter; thence on an assumed bearing of South
3.80 degrees 31 minutes 43 seconds East, along the west line of said Northeast Quarter, a
3.9distance of 362.02 feet, to the point of beginning of the land to be described; thence South
3.104 degrees 21 minutes 42 seconds East, a distance of 2286.25 feet, to the south line of said
3.11Northeast Quarter; thence westerly along said south line a distance of 152.84 feet to the
3.12southwest corner of said Northeast Quarter; thence northerly along the westerly line of
3.13said Northeast Quarter, a distance of 103.15 feet, to the south line of the north 160.7 feet
3.14of the south 263.85 feet of said Northeast Quarter; thence easterly along said south line of
3.15the north 160.7 feet of the south 263.85 feet, a distance of 45 feet, to the east line of the
3.16west 45 feet of said Northeast Quarter; thence north, along the east line of said west 45
3.17feet, a distance of 160.7 feet to the north line of said south 263.85 feet of the Northeast
3.18Quarter; thence westerly a distance of 45 feet, to the west line of said Northeast Quarter;
3.19thence northerly along said west line, to the point of beginning. Containing 4.00 acres,
3.20more or less.

3.21    Sec. 6. ADDITIONS TO STATE RECREATION AREAS.
3.22    Subdivision 1. [85.013] [Subd. 11b.] Greenleaf Lake State Recreation Area,
3.23Meeker County. The following area is added to the Greenleaf Lake State Recreation
3.24Area, Meeker County: part of Government Lot 4, Section 20, Township 118 North, Range
3.2530 West, Meeker County, Minnesota, described as follows, to wit: Beginning at a point
3.26109 feet South of a point on the section line, which is 4,301.5 feet East of the northwest
3.27corner of Section 20, said township and range, thence in a southwesterly direction South
3.2814 degrees, 36 minutes West, 403.0 feet; thence in a southeasterly direction South 75
3.29degrees, 24 minutes East, 403 feet to a point on the meandered line of Sioux Lake; thence
3.30in a northeasterly direction along the meandered line North 14 degrees, 36 minutes East,
3.31553 feet; thence in a southwesterly direction along the meandered line South 84 degrees,
3.3200 minutes West, 431 feet to the point of beginning, said tract containing 4.4 acres more or
3.33less.
4.1    Subd. 2. [85.013] [Subd. 12a.] Iron Range Off-Highway Vehicle Recreation
4.2Area, St. Louis County. The following area is added to the Iron Range Off-Highway
4.3Vehicle Recreation Area: the Southeast Quarter of the Southeast Quarter, Section 10,
4.4Township 58 North, Range 17 West.

4.5    Sec. 7. ADDITION TO STATE FOREST.
4.6[89.021] [Subd. 48.] Smoky Hills State Forest. The following areas are added to
4.7the Smoky Hills State Forest: the Southwest Quarter of the Southeast Quarter, Section
4.87, Township 139 North, Range 36 West, and the South Half of the Southwest Quarter of
4.9Section 14, Township 140 North, Range 37 West.

4.10    Sec. 8. DELETION FROM STATE FOREST.
4.11[89.021] [Subd. 31a.] Lost River State Forest. The following area is deleted from
4.12the Lost River State Forest, Roseau County: the Southeast Quarter, Section 5, Township
4.13163 North, Range 40 West.

4.14    Sec. 9. ADDITION TO STATE WILDLIFE MANAGEMENT AREA.
4.15[97A.133] [Subd. 47.] Roseau Lake Wildlife Management Area, Roseau
4.16County. The following area is added to the Roseau Lake Wildlife Management Area,
4.17Roseau County: the Southeast Quarter, Section 5, Township 163 North, Range 40 West.

4.18    Sec. 10. PRIVATE SALE OF SURPLUS STATE LAND BORDERING PUBLIC
4.19WATER; BECKER COUNTY.
4.20(a) Notwithstanding Minnesota Statutes, sections 92.45, 94.09, and 94.10, the
4.21commissioner of natural resources may sell by private sale the surplus land bordering
4.22public water that is described in paragraph (c).
4.23(b) The conveyance must be in a form approved by the attorney general. The
4.24attorney general may make necessary changes to the legal description to correct errors and
4.25ensure accuracy. The commissioner may sell the land to a local unit of government for
4.26less than the value of the land as determined by the commissioner, but the conveyance
4.27must provide that the land described in paragraph (c) be used for the public and reverts to
4.28the state if the local unit of government fails to provide for public use or abandons the
4.29public use of the land. The conveyance must include the reservation of an easement for
4.30ingress and egress through the property to the Frazee Dam.
4.31(c) The land that may be sold is located in Becker County and is described as:
4.32That part of Government Lot 2, Section 35, Township 138, Range 40, Becker County,
5.1Minnesota, described as follows: Beginning at the northwest corner of said Government
5.2Lot 2; thence on an assumed bearing of North 89 degrees 59 minutes 38 seconds East,
5.3along the north line of said Government Lot 2, a distance of 475.74 feet; thence South 0
5.4degrees 34 minutes 44 seconds East, a distance of 488.24 feet; thence South 89 degrees 59
5.5minutes 38 seconds West, a distance of 220.66 feet; thence South 0 degrees 34 minutes 44
5.6seconds East, a distance of 139.70 feet; thence South 89 degrees 59 minutes 38 seconds
5.7West, a distance of 255.08 feet, to the west line of said Government Lot 2; thence North 0

5.10(d) The land borders Town Lake and the Otter Tail River. The Department of
5.11Natural Resources has determined that the land is not needed for natural resource
5.12purposes, provided that an easement right is retained. The land is being used as a picnic
5.13and playground area.

5.14    Sec. 11. PUBLIC SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
5.15WATER; CARLTON COUNTY.
5.16(a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
5.17Carlton County may sell the tax-forfeited land bordering public water that is described in
5.18paragraph (c), under the remaining provisions of Minnesota Statutes, chapter 282.
5.19(b) The conveyance must be in a form approved by the attorney general. The
5.20attorney general may make changes to the land description to correct errors and ensure
5.21accuracy. Prior to the sales, the commissioner of revenue shall grant a permanent
5.22conservation easement according to Minnesota Statutes, section 282.37, as to the parcel
5.23described in paragraph (c), clause (3). The easement for the parcel described in paragraph
5.24(c), clause (3), shall be 132 feet in width, lying 66 feet on each side of the centerline of the
5.25designated trout stream to provide riparian protection and angler access.
5.26(c) The lands to be sold are located in Carlton County and are described as:
5.27(1) the Northwest Quarter of the Northeast Quarter or Government Lot 2, Section 6,

7.15(d) The county auditor shall first offer the land identified as parcel number
7.1692-034-5600 in paragraph (c), clause (23), to the Minnesota Department of Natural
7.17Resources for sale at the appraised value. The consideration for the sale may also include
7.18survey and appraisal costs.
7.19(e) The county auditor shall first offer the land identified as parcel numbers
7.2006-510-1010; 06-510-1020; 92-010-0920; 92-010-1150; 92-010-3010; 92-010-3120;
7.2192-010-3130; 92-010-3210; 92-010-3240; 92-010-3390; 92-034-5660; and 92-034-5730
7.22in paragraph (c), clauses (1), (2), (6), (8), (16), (17), (18), (19), (20), (22), (24), and (25) to
7.23the Fond du Lac Band of Lake Superior Chippewa for sale at the appraised value. The
7.24consideration for the sales may also include survey and appraisal costs.
7.25(f) The county has determined that the county's land management interests would
7.26best be served if the lands were returned to private ownership.
7.27EFFECTIVE DATE.This section is effective the day following final enactment.

7.28    Sec. 12. PUBLIC SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
7.29WATER; CARLTON COUNTY.
7.30(a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
7.31Carlton County may sell the tax-forfeited land bordering public water that is described in
7.32paragraph (c), under the remaining provisions of Minnesota Statutes, chapter 282.
7.33(b) The conveyance must be in a form approved by the attorney general. The
7.34attorney general may make changes to the land description to correct errors and ensure
7.35accuracy. Prior to the sales, the commissioner of revenue shall grant permanent
8.1conservation easements according to Minnesota Statutes, section 282.37, as to parcels
8.2described in paragraph (c), clauses (3), (4), and (7). The easements for the parcels
8.3described in paragraph (c), clauses (3), (4), and (7), shall be 132 feet in width, lying
8.466 feet on each side of the centerline of the designated trout stream to provide riparian
8.5protection and angler access.
8.6(c) The land to be sold is located in Carlton County and is described as:

8.31(e) The county has determined that the county's land management interests would
8.32best be served if the lands were returned to private ownership.
8.33EFFECTIVE DATE.This section is effective the day following final enactment.

8.34    Sec. 13. PUBLIC SALE OF SURPLUS STATE LAND BORDERING PUBLIC
8.35WATER; CASS COUNTY.
9.1(a) Notwithstanding Minnesota Statutes, section 92.45, the commissioner of natural
9.2resources may sell by public sale the surplus land bordering public water that is described
9.3in paragraph (c).
9.4(b) The conveyance must be in a form approved by the attorney general. The
9.5attorney general may make necessary changes to the legal description to correct errors
9.6and ensure accuracy.
9.7(c) The land that may be sold is located in Cass County and is described as: That
9.8part of Government Lot 4, Section 8, Township 140 North, Range 31 West, Cass County,
9.9Minnesota, lying southerly and westerly of the following described lines: Commencing
9.10at the southeast corner of said Government Lot 4; thence North 01 degree 39 minutes
9.1159 seconds West on an assumed bearing along the east line of said Government Lot 4
9.12a distance of 420.54 feet to the POINT OF BEGINNING; thence North 87 degrees
9.1357 minutes 14 seconds West, a distance of 481.15 feet; thence southwesterly along a
9.14tangential curve concave to the southeast having a radius of 145.00 feet, a central angle of
9.1569 degrees 00 minutes 00 seconds, for a distance of 174.61 feet; thence South 23 degrees
9.1602 minutes 46 seconds West, tangent to said curve, a distance of 255 feet, more or less, to
9.17the centerline of the old County Road; thence northwesterly, westerly, and southwesterly a
9.18distance of 520 feet along said centerline to the point of intersection with the centerline of
9.19County State-Aid Highway 6; thence northwesterly a distance of 414.53 feet along the
9.20centerline of said County State-Aid Highway 6 to the point of intersection with the west
9.21line of said Government Lot 4 and there terminating. Containing 11.16 acres, more or less.
9.22(d) The land borders Ten Mile Lake. The Department of Natural Resources has
9.23determined that the land is not needed for natural resource purposes.

9.24    Sec. 14. PRIVATE SALE OF SURPLUS STATE LAND; DOUGLAS COUNTY.
9.25(a) Notwithstanding Minnesota Statutes, sections 94.09 and 94.10, the commissioner
9.26of natural resources may sell by private sale the surplus land that is described in paragraph
9.27(c).
9.28(b) The conveyance must be in a form approved by the attorney general. The
9.29attorney general may make necessary changes to the legal description to correct errors
9.30and ensure accuracy.
9.31(c) The land that may be sold is located in Douglas County and is described as:
9.32That part of the North Half of the Southeast Quarter, Section 32, Township 130 North,
9.33Range 37 West, Douglas County, Minnesota, lying westerly of the following described
9.34centerline: Beginning at the South Quarter corner of said Section 32; thence North 00
9.35degrees 35 minutes 06 seconds West, along the centerline of Chicago Club Lane, a
10.1distance of 2,576.19 feet (the south line of the Southwest Quarter of said Section 32 has an
10.2assumed bearing of South 89 degrees 52 minutes 29 seconds West); thence northwesterly
10.3110.40 feet, along said centerline on a tangential curve concave to the southwest, having a
10.4radius of 105.00 feet and a central angle of 60 degrees 14 minutes 31 seconds to the north
10.5line of said North Half of the Southeast Quarter and said centerline there terminating.
10.6Containing 1.77 acres, more or less.
10.7(d) The Department of Natural Resources has determined that the land is not needed
10.8for natural resource purposes and that the state's land management interests would best
10.9be served if the land were conveyed to the adjacent landowner to improve access to the
10.10landowner's property.

10.11    Sec. 15. PRIVATE SALE OF SURPLUS STATE LAND BORDERING PUBLIC
10.12WATER; DOUGLAS COUNTY.
10.13(a) Notwithstanding Minnesota Statutes, sections 92.45, 94.09, and 94.10, the
10.14commissioner of natural resources may sell by private sale the surplus land bordering
10.15public water that is described in paragraph (c).
10.16(b) The conveyance must be in a form approved by the attorney general. The
10.17attorney general may make necessary changes to the legal description to correct errors
10.18and ensure accuracy.
10.19(c) The land that may be sold is located in Douglas County and is described as: That
10.20part of Government Lot 3 of Section 21, Township 130, Range 37, Douglas County,
10.21Minnesota, described as follows: Beginning at the northeast corner of Lot 12, Block
10.221, SECOND ADDITION TO TAMARACK SHORES, according to the recorded plat
10.23thereof; thence northeasterly along nontangential 223.07 foot radius curve, which center
10.24of circle bears South 51 degrees 57 minutes 52 seconds East from said point, (assuming
10.25the north line of said Lot 12 bears South 84 degrees 25 minutes 56 seconds West) central
10.26angle 25 degrees 45 minutes 18 seconds, 100.27 feet; thence South 82 degrees 58 minutes
10.2734 seconds West 401 feet more or less to the shoreline of Lake Miltona; thence southerly

11.30(a) Notwithstanding the time limit for repurchase under Minnesota Statutes, section
11.31282.241, Itasca County may allow the repurchase by December 31, 2011, by the owner of
11.32record at the time of forfeiture of the tax-forfeited land described in paragraph (b) under
11.33the remaining provisions of Minnesota Statutes, sections 282.241 to 282.324.

20.33(d) The county has determined that the county's land management interests would

21.1    Sec. 26. PRIVATE SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
21.2WATER; ST. LOUIS COUNTY.
21.3(a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision
21.41, and the public sale provisions of Minnesota Statutes, chapter 282, St. Louis County
21.5may sell by private sale the tax-forfeited land bordering public water that is described in
21.6paragraph (c), under the remaining provisions of Minnesota Statutes, chapter 282.
21.7(b) The conveyances must be in a form approved by the attorney general. The
21.8attorney general may make changes to the land descriptions to correct errors and ensure
21.9accuracy.
21.10(c) The lands to be sold are located in St. Louis County and are described as:
21.11(1) the West Half of the East Half of the West Half of the Southwest Quarter of
21.12the Northwest Quarter, Section 5, Township 54 North, Range 16 West (parcel number

21.14(2) the easterly 600 feet of Lot 2, plat of Grand Lake, lying south of the North 1200

21.21consideration, an easement to the state that is 132 feet in width, lying 66 feet on each side
21.22of the centerline of the stream, to provide riparian protection and angler access;
21.23(4) an undivided 1/2 interest of the Southwest Quarter of the Northwest Quarter,
21.24Section 12, Township 55 North, Range 20 West (parcel number 420-0030-01880).
21.25Conveyance of this land must provide, for no consideration, an easement to the state that
21.26is 132 feet in width, lying 66 feet on each side of the centerline of the river, to provide
21.27riparian protection and angler access;
21.28(5) that part of the Southeast Quarter of the Southeast Quarter described as follows:
21.29Beginning 205 feet East of the southwest corner of the Southeast Quarter of the Southeast
21.30Quarter; running thence North 208 feet; thence East 130 feet; thence southerly along
21.31the center of Rock Creek to the south line of said forty; thence West 165 feet to the
21.32point of beginning, Section 29, Township 55 North, Range 18 West (parcel number
21.33435-0020-05430); and
21.34(6) that part of Lot 7 lying southwesterly of the westerly line of the Alborn Branch
21.35of the Duluth, Missabe and Iron Range Railway, Section 5, Township 53 North, Range
21.3619 West (parcel number 440-0010-00505). Conveyance of this land must provide, for no
22.1consideration, an easement to the state that is 66 feet in width from the ordinary high

22.3(d) The county has determined that the county's land management interests would

22.5    Sec. 27. PUBLIC SALE OF TAX-FORFEITED LAND BORDERING PUBLIC
22.6WATER; STEARNS COUNTY.
22.7(a) Notwithstanding Minnesota Statutes, sections 92.45 and 282.018, subdivision 1,
22.8Stearns County may sell the tax-forfeited land bordering public water that is described in
22.9paragraph (c), under the remaining provisions of Minnesota Statutes, chapter 282.
22.10(b) The conveyance must be in a form approved by the attorney general.
22.11(c) The land to be sold is located in Stearns County and is described as:

22.31    Sec. 28. PRIVATE SALE OF SURPLUS STATE LAND BORDERING PUBLIC
22.32WATER; WATONWAN COUNTY.
22.33(a) Notwithstanding Minnesota Statutes, sections 92.45, 94.09, and 94.10, the
22.34commissioner of natural resources may sell by private sale the surplus land bordering
23.1public water that is described in paragraph (c). Notwithstanding Minnesota Statutes,
23.2section 97A.135, subdivision 2a, the surplus land described in paragraph (c) is vacated
23.3from the Watline Wildlife Management Area upon sale.
23.4(b) The conveyance must be in a form approved by the attorney general. The
23.5attorney general may make necessary changes to the legal description to correct errors
23.6and ensure accuracy. The conveyance may include reservation of an easement for public
23.7hunting, prairie management, and seed harvest.
23.8(c) The land that may be sold is located in Watonwan County and is described as:
23.9(1) in Township 105 North, Range 32 West:
23.10A strip of land 100 feet in width extending over and across the East Half of the Northwest
23.11Quarter of Section 3, said strip of land being 50 feet in width on each side of the centerline

24.22Containing a total of 32.23 acres, more or less.
24.23(d) The land is part of the former right-of-way of the Minneapolis and St. Louis
24.24Railway Company. The land borders Long Lake and St. James Lake and crosses St.
24.25James Creek and the South Fork of the Watonwan River. The Department of Natural
24.26Resources has determined that the land is not needed for natural resource purposes and
24.27that the state's land management interests would best be served if the land were conveyed
24.28to a local unit of government for trail use.

24.29    Sec. 29. CONVEYANCE OF STATE LAND; WINONA COUNTY.
24.30(a) Notwithstanding Minnesota Statutes, sections 16B.281 to 16B.287, 92.45,
24.31161.43, and 161.44, or any other law to the contrary, the commissioner of transportation
24.32may convey to the United States Fish and Wildlife Service all right, title, and interest of
24.33the state of Minnesota, in the land described in paragraph (c).
25.1(b) The conveyance must be in a form approved by the attorney general. The
25.2attorney general may make changes to the land description to correct errors and ensure
25.3accuracy. The conveyance may take place only upon completion of the Dresbach bridge
25.4project, state project number 8580-149.
25.5(c) The land to be conveyed is located in Winona County and is described as: That
25.6part of Alcorn Island located along the south side of marked Interstate Highway 90 from
25.7mile point 276.52 easterly to the westerly shoreline of the main channel of the Mississippi
25.8River. The majority of the site is in Government Lot 4, Section 34, Township 105 North,
25.9Range 4 West, and in Government Lot 5, Section 33, Township 105 North, Range 4 West.
25.10The overall site is approximately 1.4 acres.

25.11    Sec. 30. EFFECTIVE DATE.
25.12Sections 10, 13 to 15, 19, 21, and 28 are effective the day following final enactment.
