1.1A bill for an act
1.2relating to natural resources; prohibiting expenditure of funds for Lake Ogechie
1.3wild rice project until legal analysis is completed.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. LAKE OGECHIE WILD RICE RESTORATION PROJECT.
1.6The commissioner of natural resources shall not expend funds for the Lake Ogechie
1.7wild rice restoration project until the attorney general has:
1.8(1) prepared and submitted to the governor and legislature a legal analysis and
1.9opinion specifically addressing whether existing Minnesota Statutes, section 84.10,
1.10conforms properly in all ways with both the constitutions of the United States and
1.11Minnesota; and
1.12(2) prepared and submitted to the governor and legislature a legal analysis and
1.13opinion specifically addressing whether the Department of Natural Resources' working
1.14document "Summary of the Effects of Minnesota Statutes, Section 84.09 and 84.10 on the
1.15Harvesting of Wild Rice within the Original Boundaries of the Mille Lacs Reservation"
1.16conforms properly in all ways with the constitutions and how it compares with the state's
1.17legal position as expressed by both the offices of the governor and attorney general
1.18concerning the continued existence of the original Mille Lacs Indian Reservation.
1.19EFFECTIVE DATE.This section is effective the day following final enactment.
