1.1A bill for an act
1.2relating to education; clarifying the district process for reviewing curriculum,
1.3instruction, and student achievement;amending Minnesota Statutes 2012,
1.4section 120B.11.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2012, section 120B.11, is amended to read:
1.7120B.11 SCHOOL DISTRICT PROCESS FOR REVIEWING CURRICULUM,
1.8INSTRUCTION, AND STUDENT ACHIEVEMENT.
1.9    Subdivision 1. Definitions. For the purposes of this section and section 120B.10,
1.10the following terms have the meanings given them.
1.11    (a) "Instruction" means methods of providing learning experiences that enable a
1.12student to meet state and district academic standards and graduation requirements.
1.13    (b) "Curriculum" means district or school adopted programs and written plans for
1.14providing students with learning experiences that lead to expected knowledge and skills
1.15 and college and career readiness.
1.16    Subd. 2. Adopting policies. A school board shall have in place an adopted written
1.17 adopt a policy to support and improve teaching and learning that includes the following:
1.18    (1) district goals for instruction including the use of best teaching practices, district
1.19and school curriculum, and achievement for all student subgroups identified in section
1.20120B.35, subdivision 3, paragraph (b), clause (2);
1.21    (2) a process for evaluating each student's progress toward meeting state and local
1.22academic standards and identifying the strengths and weaknesses of instruction in pursuit
1.23of student and school success and curriculum affecting students' progress academic
1.24achievement and growth;
2.1    (3) a performance-based system for periodically reviewing and evaluating the
2.2effectiveness of all instruction and curriculum that includes, among other measures to
2.3improve teaching and learning, a performance-based system for annually evaluating
2.4school principals under section 123B.147, subdivision 3, and school teachers under
2.5section 122A.40, subdivision 8, or 122A.41, subdivision 5;
2.6    (4) a plan for improving instruction, curriculum, and student academic achievement
2.7 and growth; and
2.8    (5) an education effectiveness plan aligned with section sections 120B.023,
2.9subdivision 2, and 122A.625 that integrates high-quality instruction, rigorous curriculum,
2.10and technology, and a collaborative professional culture that develops teacher quality,
2.11performance, and effectiveness.
2.12    Subd. 3. District advisory committee. Each school board shall establish an
2.13advisory committee to ensure active community participation in all phases of planning and
2.14improving the instruction and curriculum affecting state and district academic standards,
2.15consistent with subdivision 2. A district advisory committee, to the extent possible,
2.16shall reflect the diversity of the district and its learning school sites, and shall include
2.17teachers, parents, support staff, students, and other community residents. The district
2.18may establish building site teams as subcommittees of the district advisory committee
2.19under subdivision 4. The district advisory committee shall recommend to the school
2.20board rigorous academic standards, student achievement goals and measures consistent
2.21with section 120B.35, district assessments, and program evaluations. Learning School
2.22 sites may expand upon district evaluations of instruction, curriculum, assessments, or
2.23programs. Whenever possible, parents and other community residents shall comprise at
2.24least two-thirds of advisory committee members.
2.25    Subd. 4. Building Site team. A school may establish a building site team to develop
2.26and implement an education effectiveness plan to improve instruction, curriculum,
2.27and student achievement at the school site, consistent with subdivision 2. The team
2.28shall advise the board and the advisory committee about developing an instruction and
2.29curriculum improvement plan that aligns curriculum, assessment of student progress in
2.30meeting state and district academic standards, and instruction.
2.31    Subd. 5. Local report. (a) By October 1 of each year, the school board shall use
2.32standard statewide reporting procedures the commissioner develops and adopt a report
2.33that includes the following:
2.34    (1) student achievement goals for meeting state academic standards;
2.35    (2) results of local assessment data, and any additional test data;
3.1    (3) the annual school district improvement plans including staff development goals
3.2under section 122A.60;
3.3    (4) information about district and learning site progress in realizing previously
3.4adopted improvement plans; and
3.5    (5) the amount and type of revenue attributed to each education site as defined
3.6in section 123B.04.
3.7    (b) Consistent with requirements for school performance report cards under section
3.8120B.36, subdivision 1, the school board shall publish a summary of the report about
3.9student achievement goals, local assessment outcomes, plans for improving curriculum
3.10and instruction, and success in realizing previously adopted student achievement goals
3.11and improvement plans in the local newspaper with the largest circulation in the district,
3.12by mail, or by electronic means such as the district Web site. If electronic means are used,
3.13school districts must publish notice of the report in a periodical of general circulation in the
3.14district. School districts must make copies of the report available to the public on request.
3.15    (c) The title of the report shall contain the name and number of the school district and
3.16read "Annual Report on Curriculum, Instruction, and Student Achievement." The report
3.17must include at least the following information about advisory committee membership:
3.18    (1) the name of each committee member and the date when that member's term
3.19expires;
3.20    (2) the method and criteria the school board uses to select committee members; and
3.21    (3) the date by which a community resident must apply to next serve on the committee.
3.22    Subd. 6. Student evaluation. The school board annually shall provide high school
3.23graduates or GED recipients who receive received a diploma or its equivalent from the
3.24school district within the two previous school years with an opportunity to report to the
3.25board by electronic means on the following:
3.26    (1) the quality of district instruction, curriculum, and services; and
3.27    (2) the quality of district delivery of instruction, curriculum, and services;.
3.28    (3) the utility of district facilities; and
3.29    (4) the effectiveness of district administration.
3.30    For purposes of improving instruction and curriculum and realizing student
3.31achievement goals, and consistent with section 13.32, subdivision 6, paragraph (b), the
3.32board must forward a summary of its evaluation findings to the commissioner upon
3.33request in the format the commissioner directs.
3.34    Subd. 7. Periodic report. Each school district shall periodically ask affected
3.35constituencies about their level of satisfaction with school. The district shall include the
3.36results of this evaluation in the report required under subdivision 5.
4.1    Subd. 8. Biennial evaluation; assessment program. At least once every two years,
4.2the district report under subdivision 5 shall include an evaluation of the effectiveness of
4.3district testing programs, according to the following:.
4.4    (1) written objectives of the assessment program;
4.5    (2) names of tests and grade levels tested;
4.6    (3) use of test results; and
4.7    (4) student achievement results compared to previous years.
4.8EFFECTIVE DATE.This section is effective the day following final enactment
4.9and applies to reports on the 2013-2014 school year and later.
