1.1A bill for an act
1.2relating to natural disasters; creating a disaster response contingency account to
1.3partially match federal disaster assistance when the legislature is not in session;
1.4appropriating money;amending Minnesota Statutes 2012, section 12A.02,
1.5subdivision 2; proposing coding for new law in Minnesota Statutes, chapter 12A.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2012, section 12A.02, subdivision 2, is amended to read:
1.8    Subd. 2. Appropriation. "Appropriation" means an a direct appropriation provided
1.9in law specifically to implement this chapter or a statutory appropriation to match federal
1.10disaster assistance under section 12A.025.

1.11    Sec. 2. [12A.025] DISASTER RESPONSE CONTINGENCY ACCOUNT.
1.12    Subdivision 1. Account; appropriation. A disaster response contingency account
1.13is created in the general fund in the state treasury. Money in the disaster response
1.14contingency account is appropriated to the commissioner of public safety only to match
1.15federal disaster assistance to state agencies and political subdivisions under section
1.1612A.15, subdivision 1, when the legislature is not in regular or special session. The amount
1.17appropriated is 60 percent of any state and local match required under the presidential
1.18declaration of a major disaster. Money appropriated under this subdivision is not available
1.19for expenditure until the commissioner of management and budget certifies that eligible
1.20local units of government have pledged the remaining forty percent of required match
1.21funds. The commissioner may use money appropriated under this subdivision to match
1.22federal disaster assistance for publicly owned capital improvement projects.
1.23    Subd. 2. Recommendation required. As part of the governor's budget submitted to
1.24the legislature under section 16A.11, the commissioner of public safety must recommend
2.1appropriations to the disaster response contingency account that the commissioner
2.2reasonably anticipates, when combined with any existing balance in the disaster response
2.3contingency account, will be sufficient to provide 60 percent of the state and local match
2.4for federal disaster assistance received during the next biennium.
