1.1A bill for an act
1.2relating to education; clarifying CPR training and instruction requirements;
1.3striking the requirement to allocate portions of reserved staff development
1.4revenue for particular purposes;amending Minnesota Statutes 2010, sections
1.5120B.236; 122A.61, subdivision 1.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 120B.236, is amended to read:
1.8120B.236 CARDIOPULMONARY RESUSCITATION AND AUTOMATIC
1.9EXTERNAL DEFIBRILLATOR INSTRUCTION.
1.10(a) School districts are encouraged to include must provide onetime cardiopulmonary
1.11resuscitation and automatic external defibrillator instruction as part of their grade 7 to 12
1.12curriculum for all students in that grade beginning in the 2014-2015 school year and later.
1.13Training and instruction provided under this section need not result in cardiopulmonary
1.14resuscitation certification. Schools offering Cardiopulmonary resuscitation or and
1.15automatic external defibrillator instruction must use include cardiopulmonary resuscitation
1.16or and automatic external defibrillator training that has been developed:
1.17(1) by the American Heart Association or the American Red Cross and incorporate
1.18psychomotor skills to support the instruction; or
1.19(2) using nationally recognized, evidence-based guidelines for cardiopulmonary
1.20resuscitation and incorporates psychomotor skills to support the instruction.
1.21"Psychomotor skills" under this paragraph means hands-on practice to support
1.22cognitive learning; it does not mean cognitive-only instruction and training.
1.23(b) School districts may use community members such as emergency medical
1.24technicians, paramedics, police officers, firefighters, and representatives of the Minnesota
2.1Resuscitation Consortium, the American Heart Association, or the American Red
2.2Cross, among others, to provide instruction and training under this section. Community
2.3members are encouraged to provide needed training and instructional resources such as
2.4cardiopulmonary resuscitation kits and other materials at no cost to the school districts. A
2.5school administrator may waive this curriculum requirement for a high school transfer
2.6student regardless of whether or not the student previously received instruction under this
2.7section, an enrolled student absent on the day the instruction occurred under this section,
2.8or an eligible student who has a disability. If a school district requests resources, the
2.9Minnesota Resuscitation Consortium must provide them to the district for instruction and
2.10training provided to students under this section.
2.11EFFECTIVE DATE.This section is effective the day following final enactment
2.12and applies to all students entering grades 7 to 12 in the 2014-2015 school year and later.

2.13    Sec. 2. Minnesota Statutes 2010, section 122A.61, subdivision 1, is amended to read:
2.14    Subdivision 1. Staff development revenue. A district is required to reserve
2.15an amount equal to at least two percent of the basic revenue under section 126C.10,
2.16subdivision 2
, for in-service education for programs under section 120B.22, subdivision
2.172
, for staff development plans, including plans for challenging instructional activities
2.18and experiences under section 122A.60, and for curriculum development and programs,
2.19other in-service education, teachers' workshops, teacher conferences, the cost of
2.20substitute teachers staff development purposes, preservice and in-service education for
2.21special education professionals and paraprofessionals, and other related costs for staff
2.22development efforts. A district may annually waive the requirement to reserve their basic
2.23revenue under this section if a majority vote of the licensed teachers in the district and
2.24a majority vote of the school board agree to a resolution to waive the requirement. A
2.25district in statutory operating debt is exempt from reserving basic revenue according to
2.26this section. Districts may expend an additional amount of unreserved revenue for staff
2.27development based on their needs. With the exception of amounts reserved for staff
2.28development from revenues allocated directly to school sites, the board must initially
2.29allocate 50 percent of the reserved revenue to each school site in the district on a per
2.30teacher basis, which must be retained by the school site until used. The board may
2.31retain 25 percent to be used for district wide staff development efforts. The remaining
2.3225 percent of the revenue must be used to make grants to school sites for best practices
2.33methods. A grant may be used for any purpose authorized under section 120B.22,
2.34subdivision 2
, 122A.60, or for the costs of curriculum development and programs, other
2.35in-service education, teachers' workshops, teacher conferences, substitute teachers for
3.1staff development purposes, and other staff development efforts, and determined by
3.2the site professional development team. The site professional development team must
3.3demonstrate to the school board the extent to which staff at the site have met the outcomes
3.4of the program. The board may withhold a portion of initial allocation of revenue if the
3.5staff development outcomes are not being met.
3.6EFFECTIVE DATE.This section is effective July 1, 2012.
