1.1A bill for an act
1.2relating to employment; requiring state agencies and professional licensing
1.3boards to expedite license processing for members of the military; providing
1.4for temporary licensure for certain military members; authorizing rulemaking;
1.5proposing coding for new law in Minnesota Statutes, chapter 197.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. [197.4552] FORMER AND CURRENT MEMBERS OF THE
1.8MILITARY.
1.9    Subdivision 1. Expedited licensing processing. Notwithstanding any other law
1.10to the contrary, each state agency and professional licensing board defined in section
1.11214.01, subdivisions 2 and 3, shall establish a procedure to expedite the issuance of a
1.12license or certification to perform professional services regulated by each state agency
1.13or board to a qualified individual who is:
1.14(1) an active duty military member;
1.15(2) the spouse of an active duty military member; or
1.16(3) an inactive military veteran who has left service in the two years preceding
1.17the date of license or certification application, and has confirmation of an honorable or
1.18general discharge status.
1.19    Subd. 2. Temporary licenses. (a) Notwithstanding any other law to the contrary,
1.20each state agency and professional licensing board defined in section 214.01, subdivisions
1.212 and 3, shall establish a procedure to issue a temporary license or certification to perform
1.22professional services regulated by each board to a qualified individual who is:
1.23(1) an active duty military member;
1.24(2) the spouse of an active duty military member; or
2.1(3) an inactive military veteran who has left service in the two years preceding
2.2the date of license or certification application, and has confirmation of an honorable or
2.3general discharge status.
2.4(b) A qualified individual under paragraph (a) must provide evidence of:
2.5(1) a current, valid license, certificate, or permit in another state without history of
2.6disciplinary action by a regulatory authority in the other state; and
2.7(2) a current criminal background study without a criminal conviction that is
2.8determined by the state agency or board to adversely affect the applicants' ability to
2.9become licensed.
2.10(c) A temporary license or certificate issued under this subdivision shall allow a
2.11qualified individual to perform regulated professional services for a limited length of time
2.12as determined by the state agency or licensing board. During the temporary license period,
2.13the individual shall complete the full application procedure as required by applicable law.
2.14    Subd. 3. Rulemaking. Each state agency or licensing board may adopt rules to
2.15carry out the provisions of this section.
