1.1A bill for an act
1.2relating to education; modifying provisions relating to allocation of funds for
1.3motorcycle safety education program;amending Minnesota Statutes 2010,
1.4section 121A.36.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 121A.36, is amended to read:
1.7121A.36 MOTORCYCLE SAFETY EDUCATION PROGRAM.
1.8    Subdivision 1. Established; administration; rules. A motorcycle safety education
1.9program is established. The program shall be administered by the commissioners
1.10commissioner of public safety and education. The program shall include but is not limited
1.11to training and coordination of motorcycle safety instructors, motorcycle safety promotion
1.12and public information, and reimbursement for the cost of approved courses offered by
1.13schools and organizations.
1.14    Subd. 2. Reimbursements. The commissioner of education public safety, to the
1.15extent that funds are available, may shall reimburse all schools and other approved
1.16organizations offering approved motorcycle safety education courses for up to 50 percent
1.17of the actual cost of the courses. If sufficient funds are not available, reimbursements
1.18shall be prorated. The commissioner may conduct audits and otherwise examine the
1.19records and accounts of schools and approved organizations offering the courses to insure
1.20the accuracy of the costs.
1.21    Subd. 3. Appropriation. (a) All funds in the motorcycle safety fund created by
1.22section 171.06, subdivision 2a, are hereby annually appropriated to the commissioner of
1.23public safety to carry out the purposes of subdivisions 1 and 2. The commissioner of
1.24public safety may shall make grants from the fund to the commissioner of education at
2.1such times and in such amounts as the commissioner deems necessary funds become
2.2available to carry out the purposes of subdivisions 1 and 2.
2.3(b) Of the money appropriated under paragraph (a):
2.4(1) not more than five percent shall be expended to defray the administrative costs
2.5of carrying out the purposes of subdivisions 1 and 2; and
2.6(2) not more than 65 percent shall be expended for the combined purpose of
2.7training and coordinating the activities of motorcycle safety instructors and making
2.8reimbursements to schools and other approved organizations.
2.9EFFECTIVE DATE.This section is effective July 1, 2012.

2.10    Sec. 2. REVISOR'S INSTRUCTION.
2.11In the next edition of Minnesota Statutes, the revisor shall recodify section 121A.36
2.12as section 171.45.
