HOUSE BILL No. 5766

July 13, 2016, Introduced by Rep. Franz and referred to the Committee on Regulatory Reform.

 

     A bill to amend 1956 PA 217, entitled

 

"Electrical administrative act,"

 

by amending section 3j (MCL 338.883j), as added by 1992 PA 130.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 3j. (1) Subject to section 5(5) or (7), the department of

 

labor shall issue a sign specialty contractor's license to a person

 

who does that meets all of the following:

 

     (a) Holds a sign specialist's license or has not less than 1

 

sign specialist residing in who resides in this state and who is in

 

his or her the person's full-time employ. The sign specialist shall

 

be actively in charge of and responsible for code compliance of all

 

installations, maintenance, connection, and repair of electric

 


signs and related wiring.

 

     (b) Files a completed application on a form provided by the

 

department. of labor.

 

     (c) Pays the examination fee prescribed in required under

 

section 3 and passes an examination provided for by the board and

 

the department. of labor.

 

     (d) Pays the license fee prescribed in required under section

 

3.

 

     (e) Provides evidence of public liability insurance coverage.

 

The board shall promulgate rules pursuant to the administrative

 

procedures act of 1969, Act No. 306 of the Public Acts of 1969,

 

being sections 24.201 to 24.328 of the Michigan Compiled Laws, 1969

 

PA 306, MCL 24.201 to 24.328, setting limits for the amount of

 

coverage depending upon on the type of application being utilized.

 

Not later than 180 days after the 1992 amendatory act that added

 

this section, the board shall submit these rules to the joint

 

committee on administrative rules.

 

     (2) A licensed electrical contractor shall not be is not

 

required to have a sign specialty contractor's license to perform

 

those installations.installations, maintenance, connection, or

 

repair of electric signs and related wiring.

 

     (3) A sign specialty contractor shall display its contractor's

 

license number on each of its vehicles, in each of its bids,

 

proposals, or job quotations, and in all of its advertising.

 

     (4) As used in this section, "department" means the department

 

of licensing and regulatory affairs.

 

     Enacting section 1. This amendatory act takes effect 90 days


after the date it is enacted into law.
