HOUSE BILL No. 5568

 

November 3, 2009, Introduced by Reps. Miller, Switalski, Polidori, Leland and Liss and referred to the Committee on Intergovernmental and Regional Affairs.

 

     A bill to authorize counties to establish a county bicycle

 

trails fund; to authorize counties to establish a county bicycle

 

sticker; to provide for the deposit of certain money in a county

 

bicycle trails fund; to provide for the use of money in a county

 

bicycle trails fund; and to prescribe the powers and duties of

 

certain county officers and officials.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. This act shall be known and may be cited as the

 

"county bicycle trails fund act".

 

     Sec. 3. (1) A county, by resolution approved by a majority

 

vote of the county board of commissioners, may establish a county

 

bicycle trails fund.

 

     (2) Money in the county bicycle trails fund shall be used


 

exclusively for the establishment or maintenance of bicycle trails

 

in the county.

 

     Sec. 5. If a county establishes a county bicycle trails fund

 

pursuant to section 3(1), the county board of commissioners of that

 

county shall create a county bicycle sticker to provide funds for

 

the county bicycle trials fund. The county board of commissioners

 

shall also establish the price, which shall not exceed $50.00, to

 

be paid for the purchase of a county bicycle sticker.

 

     Sec. 6. A county that establishes a county bicycle trails fund

 

pursuant to this act and uses those funds for the establishment or

 

maintenance of bicycle trails in the county shall not limit access

 

to those bicycle trails in the county for the sole use by

 

individuals who have purchased a county bicycle sticker.

 

     Sec. 7. (1) The county board of commissioners shall determine

 

who is responsible for administering the sale of the county bicycle

 

stickers.

 

     (2) On the last day of each month, the person or entity

 

responsible for administering the sale of the county bicycle

 

stickers shall forward all money collected from the sale of county

 

bicycle stickers to the county treasurer for deposit in the county

 

bicycle trails fund.
