HOUSE BILL No. 5052

 

 

October 3, 2017, Introduced by Reps. Jones and Marino and referred to the Committee on Local Government.

 

     A bill to amend 1913 PA 275, entitled

 

"An act to authorize the boards of supervisors of counties to

create a board of county auditors, appoint such officers, and

prescribe their powers, duties and compensation,"

 

by amending section 5 (MCL 47.5).

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5. The board of supervisors commissioners of any county

 

instead of electing all the members of the board of auditors may

 

elect by ballot appoint a board of county auditors of not to exceed

 

3 members, 1 of whom the county board of supervisors commissioners

 

shall designate as chairman chairperson of the board of county

 

auditors. If the board of county auditors consists of 1 man, he

 

shall be elected individual, that individual must be appointed for

 

a term of 1 year. ; if If the board consists of 2 men, individuals,

 

1 shall be elected must be appointed for a term of 1 year , and 1

 

must be appointed for a term of 2 years. ; if If the board consists


of 3 men, individuals, 1 shall be elected must be appointed for a

 

term of 1 year, 1 must be appointed for a term of 2 years, and 1

 

must be appointed for a term of 3 years. The term of office of each

 

of these members shall begin begins on the following January 1. At

 

each October session of the county board of supervisors preceding

 

commissioners before the expiration of the term of office of each

 

of the individual members of the board, his a successor shall must

 

be appointed by the county board of supervisors commissioners for a

 

term of 3 years from the following January 1. Every person so

 

elected appointed shall hold for the term of office indicated and

 

until his or her successor is elected appointed and qualified. No A

 

person shall not be deemed elected considered appointed as a member

 

of the board of county auditors who shall does not receive a

 

majority vote of all the members of the county board of

 

supervisors. Whenever commissioners. If a vacancy occurs in the

 

board of county auditors, it shall the vacancy must be filled by

 

the county board of supervisors, except in counties now or

 

hereafter having a population of 1,500,000 or more, vacancies shall

 

be filled as provided in section 239 of Act No. 116 of the Public

 

Acts of 1954, being section 168.239 of the Compiled Laws of 1948,

 

commissioners, and such the appointment shall be is for the

 

unexpired term of the vacancy so filled. No A person holding any

 

office either elective or appointive under any county adopting this

 

act, or any of the townships of the county, or of the this state,

 

and no a person not an elector of the county, shall be is not

 

eligible to hold the office of county auditor. No more than 2

 

members of any board of county auditors shall be affiliated with


the same political party.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless all of the following bills of the 99th Legislature are

 

enacted into law:
