Synopsis: No smoking public question. Requires an advisory local public question to be placed on the ballot in Hartford City at the November 2011 municipal elections to ask the voters of the city whether the city should adopt a municipal ordinance limiting the areas in the city where smoking will be permitted.

    A BILL FOR AN ACT concerning local government.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: ; (11)IN0055.1.1. -->     SECTION 1. [EFFECTIVE JULY 1, 2011] (a) The definitions in IC 3-5-2 apply throughout this SECTION.
    (b) The circuit court clerk of Blackford County shall place the following public question on the November 2011 municipal election ballot in the city of Hartford City:
        "Shall the city of Hartford City adopt a municipal ordinance limiting the areas in the city where smoking will be permitted?".
    (c) The county election board shall print the following immediately below the public question stated in subsection (b):
        "The vote on this question is only advisory. The result of the vote on this question is not binding on the city of Hartford City or any public official.".
    (d) The county election board shall tabulate the votes cast on the public question described in this SECTION and certify the results under IC 3-12-4-9. The circuit court clerk shall send a copy of the certification required by this subsection to the following:
        (1) The mayor of Hartford City.
        (2) The legislative body of Hartford City.
    (e) IC 3 applies to the public question placed on the ballot under this SECTION, to the extent IC 3 is not inconsistent with this SECTION.
    (f) This SECTION expires July 1, 2012.
