Synopsis: Fugitive dust from agricultural operations. Defines "fugitive dust" as the generation of particulate matter to the extent that some portion of the material escapes beyond the property line or boundaries of the property, right-of-way, or easement on which the source is located. Provides that certain regulations related to fugitive dust emissions do not apply to agricultural operations, including agricultural operations conducted by an agricultural cooperative, association, or agribusiness that services growers.

Effective: July 1, 2013.

    A BILL FOR AN ACT to amend the Indiana Code concerning environmental law.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 13-11-2-86.8; (13)IN1158.1.1. -->     SECTION 1. IC 13-11-2-86.8 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 86.8. "Fugitive dust", for purposes of IC 13-17-15, has the meaning set forth in IC 13-17-15-1.

    Chapter 15. Fugitive Dust Emissions
    Sec. 1. As used in this chapter, "fugitive dust" means the generation of particulate matter to the extent that some portion of the material escapes beyond the property line or boundaries of the property, right-of-way, or easement on which the source is located.
    Sec. 2. The provisions of 326 IAC 6-4 do not apply to fugitive dust generated by agricultural operations, including agricultural operations conducted by an agricultural cooperative, association, or agribusiness that services growers.
