1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5adding Section 28.7 as follows:
6 (415 ILCS 5/28.7 new)
7 Sec. 28.7. Agency rulemaking; statement of reasons. For any
8rulemaking proposal submitted to the Board by the Agency under
9Section 28 of this Act to adopt or amend standards for air
10quality, solid waste or hazardous waste, or water quality, the
11statement of reasons must include:
12 (1) an assessment of any differences between the proposed
13rule and:
14 (A) existing federal standards adopted under the
15 federal Clean Air Act (42 U.S.C. 7401 et seq., the federal
16 Clean Water Act (33 U.S.C. 1251 et seq.), the Resource
17 Conservation and Recovery Act (42 U.S.C. 6901 et seq.), or
18 any successor Act, as applicable;
19 (B) similar standards in states bordering Illinois;
20 and
21 (C) similar standards in states within the
22 Environmental Protection Agency Region 5; and
23 (2) a specific analysis of the need for and reasonableness

1of each difference.
2 Section 99. Effective date. This Act takes effect upon
3becoming law.
