Bill Title: Reinserts the provisions of the introduced bill with the following changes. Requires a veteran or caregiver to provide proof of veteran status and attest to the fact that the improvements to the residence are required to accommodate the veteran's disability. Provides that proof of veteran status is to be construed liberally, and veteran status shall include service in the Armed Forces of the United States, National Guard, or the reserves of the Armed Forces of the United States. Provides that what constitutes proof of veteran status shall be determined by the county, township, or municipality. Prohibits the Illinois Department of Veterans' Affairs from adjudicating any dispute arising under the provisions. Effective January 1, 2025.

Amends the Counties Code, Township Code, and Illinois Municipal Code. Provides that a veteran with a disability or the veteran's caregiver shall not be charged any building permit fee for improvements to the residence of the veteran with a disability if the improvements are required to accommodate a disability of the veteran. Provides that the applications, forms, and other paperwork required to obtain a building permit must still be submitted. Limits the concurrent exercise of home rule powers. Effective January 1, 2025.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by adding Section
55-12022 as follows:
6 (55 ILCS 5/5-12022 new)
7 Sec. 5-12022. Building permit fee for veterans with a
8disability.
9 (a) A veteran with a disability or the veteran's caregiver
10shall not be charged any building permit fee for improvements
11to the residence of the veteran with a disability if the
12improvements are required to accommodate a disability of the
13veteran. Nothing in this subsection changes the obligation of
14any person to submit to the county applications, forms, or
15other paperwork to obtain a building permit.
16 (b) A home rule county may not regulate building permit
17fees in a manner inconsistent with this Section. This Section
18is a limitation under subsection (i) of Section 6 of Article
19VII of the Illinois Constitution on the concurrent exercise by
20home rule units of powers and functions exercised by the
21State.
22 Section 10. The Township Code is amended by adding Section

3 Sec. 110-17. Building permit fee for veterans with a
4disability. A veteran with a disability or the veteran's
5caregiver shall not be charged any building permit fee for
6improvements to the residence of the veteran with a disability
7if the improvements are required to accommodate a disability
8of the veteran. Nothing in this Section changes the obligation
9of any person to submit to the township applications, forms,
10or other paperwork to obtain a building permit.
11 Section 15. The Illinois Municipal Code is amended by
12adding Section 11-13-28 as follows:
13 (65 ILCS 5/11-13-28 new)
14 Sec. 11-13-28. Building permit fee for veterans with a
15disability.
16 (a) A veteran with a disability or the veteran's caregiver
17shall not be charged any building permit fee for improvements
18to the residence of the veteran with a disability if the
19improvements are required to accommodate a disability of the
20veteran. Nothing in this subsection changes the obligation of
21any person to submit to the municipality applications, forms,
22or other paperwork to obtain a building permit.
23 (b) A home rule municipality may not regulate building
