Bill Title: Amends the Public Community College Act. Provides that beginning January 1, 2024, a community college district, upon a request from the school district of a high school located within the boundaries of the community college district, shall provide individualized disaggregated data on the enrollment of students in community college remediation courses from the most recently completed academic year. Provides that a signed remediation data sharing agreement between the school district and the community college district must be entered into before sharing remediation data. Sets forth requirements for the remediation data sharing agreement. Provides for the development and use of a model remediation data sharing agreement. Provides that a community college district may combine its negotiations with multiple school districts to establish one uniform remediation data sharing agreement or may negotiate individual remediation data sharing agreements with school districts. Sets forth provisions concerning student privacy. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public Community College Act is amended by
5adding Section 3-80 as follows:
6 (110 ILCS 805/3-80 new)
7 Sec. 3-80. Remediation data sharing agreement.
8 (a) Beginning January 1, 2024, a community college
9district, upon a request from the school district of a high
10school located within the boundaries of the community college
11district, shall provide individualized disaggregated data on
12the enrollment of students in community college remediation
13courses from the most recently completed academic year. A
14signed remediation data sharing agreement between the school
15district and the community college district must be entered
16into before sharing remediation data.
17 (b) The remediation data sharing agreement shall meet all
18of the following requirements:
19 (1) The agreement shall require that the data be
20 individualized by student and that each student record be
21 identified with the student's State identification number
22 and last previous high school within the school district,
23 as provided by the school district.

1 (2) The agreement shall provide that each student
2 record include, at a minimum, any course codes, the course
3 names or titles, and the academic department for any
4 courses that are in the department or subject area of
5 mathematics, reading, English, or communications or any
6 other course that is designated as remedial.
7 (3) The agreement shall provide that each student
8 record include, at a minimum, course codes, course names
9 or titles, and the academic department for any courses in
10 any department or subject area in which the student is
11 enrolled for a given term at the community college that
12 are noncredit-bearing courses.
13 (4) The agreement shall specify the format and method
14 by which the data will be shared with the school district.
15 (5) The agreement shall provide a timeline for which
16 the required data shall be provided to the school district
17 by the community college district, which must be at least
18 annually and must be within a reasonable amount of time
19 following the end of the academic year.
20 (6) The agreement shall provide that the data may not
21 be used in the evaluation of licensed educators.
22 (c) If, within 90 calendar days after the school
23district's initial request to enter into a remediation data
24sharing agreement with the community college district under
25this Section, the school district and the community college
26district do not reach an agreement on all of the provisions of

1a remediation data sharing agreement, then the school district
2and community college district shall jointly implement the
3provisions of the model remediation data sharing agreement
4developed under subsection (d) for those provisions for which
5an agreement could not be reached and shall jointly implement
6the remaining provisions for which agreement could be reached.
7A community college district may combine its negotiations with
8multiple school districts to establish one uniform remediation
9data sharing agreement to use with all of the school districts
10with high schools located within the boundaries of the
11community college district or may negotiate individual
12remediation data sharing agreements with school districts.
13 (d) The Illinois Community College Board and the State
14Board of Education shall develop a model remediation data
15sharing agreement that may be used by school districts and
16community college districts under this Section. The model
17remediation data sharing agreement shall address all of the
18matters set forth in subsection (b) and shall be completed by
19January 1, 2024.
20 (e) The sharing of data under this Section must be in
21accordance with the requirements of the federal Family
22Educational Rights and Privacy Act of 1974. Nothing in this
23Section supersedes the federal Family Educational Rights and
24Privacy Act of 1974 or rules adopted pursuant to the federal
25Family Educational Rights and Privacy Act of 1974 or any
26federal or State laws or rules governing student privacy
