1 | AMENDMENT TO SENATE BILL 1996

2 | AMENDMENT NO. ______. Amend Senate Bill 1996 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Mobile Home Landlord and Tenant Rights Act | ||||||
5 | is amended by adding Section 14.2 as follows:
| ||||||
6 | (765 ILCS 745/14.2 new) | ||||||
7 | Sec. 14.2. Relocation plan. The Department of Public | ||||||
8 | Health shall facilitate the development of a plan to address | ||||||
9 | the relocation efforts of manufactured home or mobile home | ||||||
10 | owners who are compelled to relocate due to (i) the sale of the | ||||||
11 | manufactured home community or mobile home park in which they | ||||||
12 | live to a person or entity which will use the property for a | ||||||
13 | use other than as a manufactured home community or mobile home | ||||||
14 | park or (ii) the closure of or the cessation of the operation | ||||||
15 | of the manufactured home community or mobile home park in which | ||||||
16 | they live. The plan shall be developed in cooperation with |

1 | members of the General Assembly, manufactured home owners, | ||||||
2 | mobile home owners, manufactured home community owners, mobile | ||||||
3 | home park owners, and the respective statewide organizations | ||||||
4 | that represent manufactured home owners, mobile home owners, | ||||||
5 | manufactured home community owners, or mobile home park owners. | ||||||
6 | Both the Illinois Department of Public Health and the Illinois | ||||||
7 | Housing Development Authority will participate in this | ||||||
8 | collaborative effort by providing office space for meetings and | ||||||
9 | information on matters that arise in which the agencies have | ||||||
10 | expertise, such as issues relating to public health and options | ||||||
11 | for affordable housing, respectively. The plan shall include | ||||||
12 | provisions for the special counseling of manufactured home or | ||||||
13 | mobile home owners displaced from the manufactured home | ||||||
14 | community or mobile home park in which they live; the | ||||||
15 | relocation or shelter needs of displaced manufactured home or | ||||||
16 | mobile home owners; and the creation of a Manufactured Housing | ||||||
17 | Relocation Fund. The plan may include proposed legislation. No | ||||||
18 | later than October 1, 2011, the plan and any proposed | ||||||
19 | legislation shall be submitted to the President of the Senate, | ||||||
20 | the Senate Minority Leader, the Speaker of the House of | ||||||
21 | Representatives, and the House Minority Leader.

22 | Section 99. Effective date. This Act takes effect upon | ||||||
23 | becoming law.".
